Minutes of MADISON VILLAGE Meeting Held April 02, 2001

 

 

REGULAR MEETING              April 02, 2001

 

Mayor David Reed called the meeting to order at 7:00PM and invited those in attendance to join in the pledge of allegiance.  Council members Mr. Britton, Mr. Burgard, Mrs. Kopczak, Mr. Loparo, and Mr. Smith were present.  Also in attendance were Clerk-Treasurer Butler, Solicitor Collins, Engineer Foley, Chief Matty and Administrator Sample. Councilman Mr. Evangelista was absent.

 

Mr. Burgard motioned to approve the minutes of the March 5, 2001 Regular Meeting.  Mr. Smith seconded.  All present were in favor. Clerk-Treasurer Butler presented Pay Order No. 2000 totaling $89,712.64. Mr. Loparo motioned for approval.  Mr. Smith seconded.  All present were in favor. Mrs. Kopczak inquired if a portion of CT Consultant’s fee was reimbursed to the Village.  Clerk-Treasurer Tracy Butler responded that a portion was for engineering in/out.  

 

VISITORS

 

Jack Lading, 603 West Main Street, commended Madison Village Police with traffic flow during the pending waterline work on River Street.  He asked Council how will prevent traffic bottle-necking due to delivery trucks on Main Street during the Route 534 traffic detour through the Village.  Chief Matty stated that per ordinance, a maximum time of 30 minutes is permitted for unloading zones.  Solicitor Collins added that the Village does not have designated zones, however per the Ohio Revised Code, delivery trucks cannot impede the flow of traffic.  Mr. Lading suggested that UPS and Federal Express be notified to deliver via the alley.  Mayor Reed stated that the Village follow through with a  letter to the delivery companies.

 

PRESENTATION OF 2000 CHRISTMAS DECORATION AWARDS

 

Mayor Reed presented placques to Mrs. Michael Loparo of Robinson’s Emporium and Mrs. Eileen Findak of Findak Photography with the 2000 Village Merchant Christmas awards.    

 

OLD BUSINESS

 

ORDINANCE NO. 19-2001 was read by Solicitor Collins for the second time.  AN ORDINANCE AUTHORIZING AND DIRECTING THE VILLAGE ADMINISTRATOR AND CLERK-TREASURER TO ENTER INTO A CONTRACT WITH GEHRING’S AGENCY, INC, ON BEHALF OF GENERAL STAR NATIONAL INDEMNITY COMPANY, FOR PUBLIC OFFICIALS LIABILITY INSURANCE FOR MADISON VILLAGE, AND DECLARING AN EMERGENCY.   Mr. Loparo motioned to suspend the three reading rule.  Mr. Burgard seconded.  All present were in favor.  Mr. Loparo moved for passage.  Mr. Burgard seconded.  All present were in favor. 

 

NEW BUSINESS

 

ORDINANCE NO. 20-2001 was read by Solicitor Collins for the first time.  AN ORDINANCE INCREASING THE COMPENSATION FOR MEMBERS OF COUNCIL ELECTED OR APPOINTED TO A TERM OF OFFICE COMMENCING IN OF AFTER JANUARY, 2002, AND DECLARING AN EMERGENCY.

 

ORDINANCE NO. 21-2001 was read by Solicitor Collins for the first time.  AN ORDINANCE ACCEPTING THE BID OF, AND AUTHORIZING AND DIRECTING THE VILLAGE ADMINISTRATOR AND CLERK-TREASURER TO ENTER INTO A CONTRACT WITH C.I.R., INC., FOR THE SAFFORD STREET SANITARY SEWER REPLACEMENT PROJECT. 

The amount of the bid is $25,998.00.  Mr. Burgard motioned for suspension.  Mr. Smith seconded.  All present were in favor.  Mr. Burgard moved for passage.  Mr. Loparo seconded.  All present were in favor. 

 

ORDINANCE NO. 22-2001 was read by Solicitor Collins for the first time.  AN ORDINANCE ENTERING AMENDING THE AGREEMENT WITH CT CONSULTANTS, INC. FOR PROFESSIONAL ENGINEERING SERVICES.

 

ORDINANCE NO. 23-2001 wasd read by Solicitor Collins for the first time.   AN ORDINANCE PROVIDING FOR ADDITIONAL APPROPRIATIONS AND ADJUSTMENTS TO VARIOUS LINE ITEMS FOR THE CURRENT EXPENSES AND FOR OTHER EXPENDITURES OF THE VILLAGE OF MADISON, OHIO, FOR THE PERIOD OF BEGINNING JANUARY 1, 2001 TO AND INCLUDING DECEMBER 31, 2001 AND DECLARING AN EMERGENCY.  Mr. Loparo motioned for suspension.  Mr. Burgard seconded.  All present were in favor.  Mr. Loparo moved for passage.  Mr. Burgard seconded.  All present were in favor.  Prior to passage of Ordinance No. 23-2001, Mrs. Kopczak asked for an explanation for additional appropriation.  Clerk- Treasurer Butler and Chief Matty stated that the increase was unavoidable due nationwide increases which have doubled for police liability protection.   Mr. Collins stated that quotes cannot be obtained from insurance companies for more than 30-45 days in advance.  In addition, the Supreme Court’s recent rulings caused several liability carriers to move out of the state of Ohio.  Therefore, the Village had to switch companies to secure police coverage.   

 

RESOLUTION NO. 10-2001 was read by Solicitor Collins for the first time.  A RESOLUTION RECOGNIZING MAY 2001 AS RABIES AND ANIMAL BITE PREVENTION MONTH.  Mr.  Smith motioned for passage.  Mr.  Burgard seconded.  All present were in favor.

 

DISCUSSION

 

Mayor Reed received a request from Peggy Burnheimer of Concerts in the Park to reserve the first two Thursdays in September.

Mr. Loparo stated that the only complaints he has received are for Friday dates because of lack of parking during these events.

Food vendors at Village Park need to be properly certified and inspected.  Council approved September 13 and 20 for Concerts in the Park.

 

 

COUNCIL REPORTS

 

Mr. Loparo informed Council he sent a letter to State Representative Ron Young requesting funds for computer training at the Senior Center, an assistant for the Senior Center Director, and hazard tree removal and pest control for seniors.  He thanked Chief Matty for dispatching officers to patrol the crosswalks for pedestrians.

 

Mrs. Kopczak asked Administrator Sample when will the Village be entering into a new health insurance contract.  He replied as soon as the bids are opened, legislation will be presented after a decision is made.

 

Mr. Britton reported that he received a call from a local resident about the various toter colors throughout the Village.  Per the agreement, all toters must be one color.  Administrator Sample replied that he received a call, and will contact the garbage company to get uniform toters.  Mr. Britton requested funds from the Village for 50% of $5363 for roofing, siding, and soffits of Fire Station No.1 since the building is owned by the Village.  Solicitor Collins stated that the Village will provide funds, not to exceed $2700 as a formal approval.  Mr. Burgard motioned for approval.  Mr. Britton seconded.  All present were in favor.

 

Mr. Smith announced a Fire Board Workshop will be held on Wednesday at 7:30PM at Village Hall.

 

ENGINEER’S REPORT

 

Mr. Foley reported that the East Main and River Street Watermain contractor is beginning the second phase.  River Street is complete with the exception of the tank.  Service connections are switched over.  They will be working to expedite the schedule.  Mr. Foley sent a letter to ODOT requesting a traffic signal  for the south ramp on I-90 during the Route 534 detour.  There has been no response yet.  Mayor Reed stated that the Grade Separation Workshop with Madison Township was held the prior Monday evening.

One course of action is to seek funding for assistance.  Engineer Foley added that the County Engineer’s office can fascilitate the survey aspect.  County Engineer Tim Gills, who was present, spoke of support from his office.  A formal request will be sent to the Lake County Engineer for the acquisition of funds for grade separation.  A copy will be sent to Madison Township.

 

SAFETY REPORT

 

Chief Matty reported March’s Safe Driver was awarded to Kenneth Dresmond from Hyder Drive in Madison Village.

He requested a resolution for Oliver Wood, a FoodPride worker, who helped rescue a man being dragged by his truck.  Also, he requested a resolution for Patricia Northcott, a dispatcher of 30 years.  He added that range practice was completed.  Officers Dawn Shannon is attending Field Training Officer class at Lakeland Community College.  Officer Verdi will attend next.  Both officers will be working opposite each other  for training coverage.  Officer Brennan will be attending an F.B.I. class at LCC.  Officer Verdi will be attending a class for first responder by First Energy for law enforcement and fire personnel.  He invited John Sample to send a road crew worker since they clear trees after storms.  Chief Matty proposed to Council that he schedule a foot patrol officer for community assistance, as well as enforcing parking, moving and handicap violations.   Since he has received one grant for $1000.00, and will be getting another grant for $1000.00 in May, he suggested using that money towards this officer’s wages.  Mayor Reed encouraged Council to think about adding an additional officer for the Main Street area.  No new hires will be needed.  Part-time and auxilliary officers can be scheduled.  Mr. Britton added that there are a number of motorists that make rolling stops at Main and River Streets.  The presence of an officer may help curb this traffic violation.  Chief Matty was given approval, and will submit a job description to Council.

 

ADMINISTRATOR’S REPORT

 

Administrator Sample received a request from the  Fellowship of Christian Athletes for the use of the bandstand May 19, 11AM-9PM.  Afternoon usage is more conducive from a merchant business standpoint.  Council approved the event with an ending time of 6PM.  Sample reported the commencement of brush pick-up.  Other up-coming projects include leaf pick-up, painting of crosswalks, two tree removals, and the tree planting program.  Discussion was held on 2001 Census results for communities.  Madison Village was reported to have 2,900+ residents, an increase of only 440 people.  This number is low considering 309 homes have been built within the past 10 years.  Sample has budgeted for a new sign at Dayton Road and requested to purchase a new sign.  American International has agreed to pay 50% of the total cost at $1150.00.   The old sign will be removed from the current owner’s property.  Mr. Britton motioned for approval for authorization.  Mr. Burgard seconded.  All present were in favor, except for Mrs. Kopczak who voted against.

 

MAYOR’S REPORT

 

Mayor Reed brought up a letter that Clerk-Treasurer Butler copied to Council regarding Painesville Municipal Court costs.  The court costs will be invoiced to all Lake County communities beginning the 2002 fiscal year.  Chief Matty will incorporate this cost in the following year’s budget.  The General Health District will be holding a seminar about the West Nile Virus on April 18.  Administrator Sample will represent the Village.  Mayor Reed will provide copies of the Ohio Municipal League’s bulletin on local government freezes.  He requested legislation be prepared to increase the payment in lieu of insurance from $60.00 to $75.00 to cover Director Burgard’s health converage increases on her husband’s plan.  The Mayor stated this still leaves the Village a significant savings by Director Burgard opting not to have Village health coverage.  A Senior Board meeting will be held April 11.
