Minutes of Madison Village Meeting held August 11, 2003
REGULAR MEETING August 11, 2003
Mayor Evangelista called the meeting to order at 7:04 pm and invited all in attendance to join in the Pledge of Allegiance.
Council Members Mr. Britton, Mr. Buck, Mr. Loparo, Mr. Smith, and Mr. Toward were present. Mr. Burgard was absent. Also in attendance were Administrator Sample, Clerk-Treasurer Reed, and Chief Matty.
Mr. Loparo motioned to approve the minutes of the July 14, 2003 Public Hearing and Regular Meeting. Mr. Britton seconded. All present were in favor. Mr. Loparo motioned to approve the minutes of the July 28, 2003 Special Meeting. Mr. Smith seconded. All present were in favor except Mr. Britton who abstained.
Clerk-Treasurer Reed presented Pay Ordinance #2049 totaling $136,348.12. Mr. Loparo motioned to approve Pay Ordinance #2049. Mr. Smith seconded. All present were in favor.
Mr. Wayne Clough of 194 Manchester Court spoke in favor of Ordinance #36-2003, the Historical Preservation District Ordinance. He endorses the Ordinance. He also stated that he mailed a letter about a week ago regarding the flooding between 194 and 198 Manchester Court. He wanted to add that nothing has changed since the time last week that the Mayor was at the property. No grading has been done. He also questioned the fact that property owners would be notified if they didn’t mow their lawns. He saw a statement in the water bill referring to mowing of the lawns and that there must be an ordinance that allows the Village to do that. He questioned why C & G Development has not been made to mow their yards properly.
Mr. Gary Roberts of C & G Development stated that on tonight’s agenda is the Ordinance to approve the final plat of Huntington Woods. The concerns of Council have been addressed, such as landscaping of the cul-de-sacs, backfilling of sidewalks and mowing of the grass. They mow the lots that C & G owns, but the other lot owners are responsible for their own lots. He is requesting that Ordinance #22-2003 be taken off the table tonight and be voted on.
Mr. Chris Brown of Rustic Homes stated that they were waiting for the settling of the footer drain that he put in. That project is finished, as he has gone out there in the rain and there is no flooding.
Mr. Chuck Dome of 190 Manchester Court thanked C & G Development and Rustic Homes for all they have done. He knows they are trying to do the best they can. If C & G and Rustic Homes can assure the residents that they will take care of any draining problems that may occur this fall, than the ordinance should be approved.
Mr. Jack Lading of 603 W. Main Street questioned when the special meeting was advertised in the newspapers. Administrator Sample stated that he notified the newspapers on the Friday before the Monday meeting. Mr. Lading stated that he called the News Herald on Tuesday morning and three different people told him there was no record of notification. Administrator Sample stated that the sunshine laws state that the newspaper needs to be notified 24 hours in advance. He faxed the Star Beacon and the News Herald and called the Tribune.
Mr. Lading also stated that he is a morning walker and he sees trash thrown in people’s yards. He wants to know if one of the police officers witnesses someone littering, can they be cited? Chief Matty stated that it is discretionary, but a citation could be issued. He stated that many residents take a lot of time to make their yards look nice and he is sure they are tired of picking up trash on a daily basis. Mayor Evangelista stated that the police department could be made aware of the situation.
Mr. Wayne Clough takes exception to what Mr. Chuck Dome said. He doesn’t like the ‘wait and see’ attitude. He would like to see a deadline set and if the work is not done on time, hire a third party and tap into the performance bond.
Mr. Bob Melzer of 188 Kingsbury Point feels that this has been the wettest season in a long time. He is asking everyone to take into consideration that there is a lot of water everywhere. To delay the Huntington Woods issue any longer makes no sense. He does have an issue with the overpass situation. He would like to speak to someone concerning that issue. Mayor Evangelista asked Mr. Buck to call him and update him on the overpass situation.
Mr. Chris Brown of Rustic Homes explained to Mr. Clough that he put a footer pipe between the houses with holes in it and twelve inches of gravel all the way from front to back. The swale will be wet after it rains. The grass cannot be mowed immediately after it rains. You must wait until it dries up a bit. The 4-inch pipes were put in and allowed to settle. They came back to trim the top off the pipe after it settled.
Mr. Toward motioned to remove from the table Ordinance #22-2003. Mr. Loparo seconded. All present were in favor.
ORDINANCE #22-2003 was read by Administrator Sample. AN ORDINANCE APPROVING THE FINAL PLAT AND THE FINAL SUBDIVISION IMPROVEMENT PLANS OF PHASE II OF HUNTINGTON WOODS SUBDIVISION. Mr. Loparo motioned for passage of Ordinance #22-2003. Mr. Britton seconded. All present were in favor.
ORDINANCE #30-2003 was read by Administrator Sample for the third time. AN ORDINANCE AMENDING THE GENERAL TRAFFIC CODE TO REGULATE THE STORAGE OF UNLICENSED MOTOR VEHICLES AND TO ADD NEW SECTION 351.14. Mr. Toward motioned for passage of Ordinance #30-2003. Mr. Buck seconded. All present were in favor.
ORDINANCE #36-2003 was read by Administrator Sample for the second time. AN ORDINANCE ESTABLISHING THE HISTORIC PRESERVATION DISTRICT AND LISTED PROPERTIES FOR THE VILLAGE OF MADISON, OHIO, AND PROVIDING FOR THE ADMINISTRATION ENFORCEMENT AND AMENDMENT THEREOF, ALL FOR THE PURPOSE OF PROMOTING THE PUBLIC WEALTH, SAFETY, MORAL, COMFORT AND GENERAL WELFARE OF THE RESIDENTS OF THE VILLAGE.
ORDINANCE #37-2003 was read by Administrator Sample for the second time. AN ORDINANCE AUTHORIZING AND DIRECTING THE SUBMISSION TO THE ELECTORS OF THE VILLAGE OF MADISON, OHIO A REFERENDUM RELATING TO THE CONTINUED TAXATION OF A SHAREHOLDER’S DISTRIBUTIVE SHARE OF NET PROFITS FROM AN ‘S’ CORPORATION AND DECLARING AN EMERGENCY. Mr. Loparo motioned to suspend the three reading rule. Mr. Smith seconded. All present were in favor. Mr. Britton motioned for passage of Ordinance #37-2003. Mr. Buck seconded. All present were in favor.
ORDINANCE #42-2003 was read by Administrator Sample for the first time. AN ORDINANCE AUTHORIZING AND DIRECTING THE CLERK-TREASURER AND VILLAGE ADMINISTRATOR TO EXECUTE A CONTRACT FOR AN EASEMENT WITH ROBIN KEYERLEBER FOR SANITARY SEWER PURPOSES AND DECLARING AN EMERGENCY. Mr. Smith motioned for suspension of the three reading rule. Mr. Buck seconded. All present were in favor. Mr. Toward motioned for passage of Ordinance #42-2003. Mr. Buck seconded. All present were in favor.
ORDINANCE #43-2003 was read by Administrator Sample for the first time. AN ORDINANCE AUTHORIZING AND DIRECTING THE VILLAGE ADMINISTRATOR AND CLERK-TREASURER TO ENTER INTO A CONTRACT WITH NORFOLK SOUTHERN RAILWAY COMPANY FOR A LICENSE AGREEMENT ALLOWING MADISON VILLAGE TO INSTALL A SANITARY SEWER LINE, AND DECLARING AN EMERGENCY. Mr. Buck motioned for suspension of the three reading rule. Mr. Britton seconded. All present were in favor. Mr. Britton motioned for passage of Ordinance #43-2003. Mr. Buck seconded. All present were in favor.
ORDINANCE #44-2003 was read by Administrator Sample for the first time. AN ORDINANCE AMENDING AMENDED ORDINANCE #46-1996 SECTION 6, SO AS TO MODIFY THE SEWER TAP-IN FEES FOR VARIOUS USES.
RESOLUTION #15-2003 was read by Administrator Sample. A RESOLUTION HONORING DAVID HEARN AS AN OUTSTANDING MADISON AREA RESIDENT. Mr. Britton motioned for passage of Resolution #15-2003. Mr. Toward seconded. All present were in favor.
Mr. Britton reported that the set up of Madison Old Fashioned Days ran very smoothly. The Thursday night parade lined up easily. The concessionaires said that was the biggest crowd they have seen on a Thursday night at OFD. He thanked everyone for helping and making the Old Fashioned Days run so smooth.
Mr. Smith reported that there was a great crowd at OFD. He asked Administrator Sample to pass on to the road department that they did a fantastic job of cleaning out by the Madison Woods. There is a special fireboard meeting tomorrow night, August 12, 2003 to vote on a new squad.
Mr. Buck thanked Administrator Sample for taking care of a few obtrusive signs on Main Street. He spoke with the owners of a Painesville Township business that is looking for a building with 30,000 square feet of space, but was unable to help them. He referred them to the Chamber of Commerce.
Engineer Eric reported that the concrete curbs are in at Huntington Woods Phase II. The roadway grading will take place this week in anticipation of the asphalt paving. They are also in the process of setting up a pre-construction meeting with Snavely Excavating for the sanitary sewer project.
Chief Matty reported that for Old Fashioned Days, 369.5 man-hours were used. The paid hours included 301 hours and 68.5 hours were unpaid. There were also some undocumented hours that involved preparation and cleanup. Chief Matty is looking for guidance from council regarding the TAC Computer program that was introduced at the last regular council meeting by Thomas Craven. Mr. Britton motioned to proceed with the records management system. Mr. Toward seconded. All present were in favor.
Chief Matty appointed Tim Gleba as a part time patrolman with Madison Village. Mr. Britton motioned to ratify the appointment of Tim Gleba. Mr. Smith seconded. All present were in favor. Solicitor Murray proceeded to swear in Officer Tim Gleba. Congratulations Officer Gleba.
Administrator Sample reported that he would like to receive authorization to purchase road salt. Mr. Smith motioned to approve the purchase of salt. Mr. Toward seconded. All present were in favor.
Administrator Sample reported that during OFD, people made the comment to him that the reason the taxes are so high is because they have all new trucks. In reality, some of the trucks were six to seven years old, but because the crew does a fine job of maintaining them, they look new.
Mayor Evangelista stated that the police striping has been finished on the new car. He asked for Council’s opinion. Everyone agreed it looked very nice.
Mayor Evangelista reported that he has received many comments on the sign on Lake and Route 84 that states, “turn on red except…” This apparently confuses many people, so he is asking that the sign be changed to “turn on red between…” Mr. Toward suggested that an accessory be put on the light that is clearly marked with either an arrow or a red light. Mayor Evangelista said that is a good suggestion.
Mayor Evangelista is currently in the process of putting together an interview list for a temporary assistant to Tracy Butler while she is assisting Clerk-Treasurer Reed.
Some upcoming dates include: August 14, 2003 is Mayor’s Court, and August 28-31, 2003 the replica of the Viet Nam wall will be on display in the park.
Clerk-Treasurer Reed has a statement pertaining to the no interest loans and the interest loans that the Village has. The interest loans are locked in at the then current rate of 7-8%, which now are unheard of rates. Clerk-Treasurer Reed inquired last year about reducing the rate but was informed that these rates were locked in. About a month ago, he received correspondence that they will be reduced by 1%, which will be a savings to the Village. Also, as of July of 2003, the Ohio P.E.R.S. program changed their rules of employer payments. Employers are now required to pay monthly instead of quarterly, their withholdings portion. The Ohio P.E.R.S. program will defer the second quarter employer portion payments for 2004, 2005, and 2006. This could potentially be close to $18,000 –20,000 for this year.
