Record of Proceedings

 

Mayor Evangelista called the meeting to order at 7:04 p.m. and invited all in attendance to join in the Pledge of Allegiance to the American Flag.  Mayor Evangelista requested that everyone observe a moment of silence.  Council Members Mr. Britton, Mr. Hamercheck, Mr. Lee, Mr. Loparo and Mr. Vest were present. Also in attendance, Mayor Evangelista, Administrator Zapp, Solicitor Murray, Police Chief Forsythe, and Fiscal Officer Pinkert. 

 

NEW BUSINESS

 

Mayor Evangelista informed everyone that the first order of business is to accept the resignation of Councilman Larry Buck.

Solicitor Murray informed everyone that Mr. Buck submitted his letter of resignation on Friday, August 25, 2006, and said that the resignation is effective at the time it reaches the Mayor and all of Council.  Mayor Evangelista submitted the letter of resignation to all of Council on Saturday, August 26, 2006, and that from a legal standpoint, the service to all Council would have been complete on the next business day; August 28, 2006.  Solicitor Murray recommended a motion be made to accept the resignation of Larry Buck effective August 28, 2006.  Motion by Mr. Lee, seconded by Mr. Britton, to accepting the resignation of Larry Buck effective August 28, 2006.  Roll call on the motion, 5 yeas.  Motion carried.

 

Solicitor Murray explained that Council has thirty (30) days to fill the vacant council seat by an election of Council.  After thirty (30) days, the decision falls exclusively to the Mayor.  The person selected will fill the remainder of Mr. Buck’s term which runs through December 31, 2009.  Solicitor Murray said that September 27, 2006, is the deadline for a decision by Council.  Mr. Loparo said that it is imperative that Council move expeditiously due to some important issues on the agenda. 

 

There was a discussion about advertising for applications, interview dates and meeting dates.

 

Administrator Zapp said that he will run a local press release stating applications for consideration to fill the vacant Council seat will be accepted until Friday September 8, 2006, at 4:30 p.m.

Solicitor Murray said that the applications should be submitted to the President Pro-tem of Council and that the staff should time and date stamp applications as received. 

Mr. Lee requested copies of applications be forwarded to members of Council.

 

Motion by Mr. Britton, seconded by Mr. Lee, to plan special meetings of Madison Village Council on September 13, 2006, and September 15, 2006, at 7:00 p.m. for executive session to review applications and or conduct interviews.  Roll call on the motion, 5 yeas.  Motion carried. 

 

Mr. Lee requested the press release include a request of the applicants to include why they want to be considered for a seat on Council.  

 

 

 

Motion by Mr. Britton, seconded by Mr. Hamercheck, for executive session for personnel at 7:22 p.m.  Roll call, 5 yeas.  Motion carried.  Mayor Evangelista informed everyone that there will be a ten minute recess and that there will be no business afterward.
