COUNCIL MINUTES
VILLAGE OF MADISON
Regular Meeting
August 9, 2004
Mayor Evangelista called the meeting to order at 7:14 p.m. and invited all in attendance to join in the Pledge of Allegiance to the American Flag.
Council members Mr. Buck, Mr. Burgard and Mr. Toward were present. Also in attendance; Mayor Evangelista, Administrator Sample, Solicitor Murray, Fiscal Officer Pinkert and Eric Haibach for Engineer Foley
Mayor Evangelista informed everyone that business for consideration of Council will be delayed until there are at least 4 members present. He added that Mr. Britton was delayed and is on his way.
Susan Quayle, 715 West Main Street, said that recently she had contacted Council members about the fence adjacent to her property and was told the fence would be moved. She asked when it will be moved. Administrator Sample answered in the next two weeks.
Maureen Mitchell, Princeton Drive, expressed appreciation to Police Chief Matty and Officer Verdi for their action during her identity theft incident. She informed everyone that four people were apprehended and convicted and requested a resolution of appreciation from Council for Chief Matty and Officer Verdi. She also distributed information about the House Subcommittee meeting regarding identity theft.
Mr. Toward gave an update on the water tower repainting. He explained that the horses being painted on the water tower can be purchased for $5,000 in order to help fund the project. He added that there are possibly two people interested in purchasing horses.
Mr. Buck said that the Planning Commission has approved signage for Lakeland Community College (LCC). He added that LCC also wants to put up a high rise sign along the back property and that it may be a problem.
Mr. Burgard said that there is a Fire Board meeting on August 18, 2004 at village hall.
Eric Haibach gave an update on the water and sewer projects and said that Betteley Construction is almost ready for connection to sanitary and storm sewer at Bear Path.
Acting Police Chief Mark Forsythe gave an update about Old fashioned days and thanked all the officers and employees that helped make it a success.
He reported the following:

406 Fingerprintings by the Auxiliary Forces with materials supplied by the Masonic Lodge
2. He has completed First Line Supervision Class
3. Ian Mussel completed Patrol Investigations & Techniques training.
Administrator Sample reported the following:
19 new home permits year to date.
Water testing is in process
Smoke testing will be performed on Hyder Drive in September, including a house by house inspection.
2 years of the Storm Water Management program costs are $13, 000 compared to other entities tax assessments the village have saved $35,000 per year.
Catch basins are being cleaned and marked
Storm sewer analysis can be performed three days after a rain event.
An application for a Nature works grant will be available soon for the ball fields
Village Crews picked up 900 World Resource toters and delivered the Waste Management toters.
Mayor Evangelista reported the following:
The last pick-up day for World Resources was July 19th; Waste Management will complete the current contract. He hasn’t heard any complaints since Waste Management took over the garbage pick-up.
Old Fashioned Days were outstanding for everyone. The civil war cannon was dedicated Friday August 6th at Old Fashioned Days.
The Design & Review Board met on July 14th and started a file on each building with a color picture for historical background.
Income tax revenues are down compared to last year.
Planes will be dropping rabies vaccine bait in a controlled zone. Anyone handling it should wear gloves.

Mr. Britton entered the meeting in progress and took his seat. Mr. Britton reported that Old Fashioned Days was a success with approximately $8,700 in car ticket sales. He added Mr. Caldwell of Anthony Court in Madison Township won the car.
Mr. Buck said that he said the sign at the park is to low not to high as stated in the minutes and requested the correction.
Motion by Mr. Buck, seconded by Mr. Britton, to approve the minutes of the regular meeting on July 12, 2004, with the amendment. Roll call on the motion, 4 yeas. Motion passed.
Fiscal Officer Pinkert presented Pay Ordinance #2072 totaling $136,124.80 for current and upcoming expenses. Motion by Mr. Burgard, seconded by Mr. Toward, to approve Pay Ordinance #2072. Roll call on the motion, 4 yeas. Motion passed.
OLD BUSINESS
ORDINANCE NO. 50-2004 was read by Administrator Sample, second reading. AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR AND ADMINISTRATOR TO ENTER INTO AN ANNEXATION AGREEMENTWITH THE TOWNSHIP OF MADISON FOR THE ANNEXATION OF APPROXIMATELY EIGHTY SEVEN ACRES OF LAND
NEW BUSINESS
ORDINANCE NO. 52 – 2004 was read by Administrator Sample, first reading. AN ORDINANCE AMENDING THE TRAFFIC CODE ORDINANCE NO. 48-1991 TO INCLUDE NEW SECTION 337.30 PROHIBITING THE USE OF COMPRESSION BRAKES AND/OR THE USE OF ENGINE RETARDERS ON MUNICIPAL STREETS IN THE VILLAGE OF MADISON.
ORDINANCE NO. 53 – 2004 was read by Administrator Sample, first reading. AN ORDINANCE ESTABLISHING A MAYOR’S COURT COMPUTERIZATION FUND TO BE USED FOR THE COMPUTERIZATION OF THE OFFICE OF THE CLERK OF MAYOR’S COURT AND ESTABLISHING THE FEE THEREON.
Mayor Evangelista requested a 10 minute recess followed by an executive session to discuss legal and personnel matters and informed everyone there will be no business after the executive session.
Motion by Mr. Britton, seconded by Mr. Buck, to adjourn to executive session to discuss legal and personnel issues following a 10 minute recess. Roll call, 4 yeas. Motion passed.
Council adjourned for a recess and executive session to discuss legal and personnel matters at 7:38 p.m..
