Minutes of Madison Village Meeting held December 15, 2003

 

 

Regular Meeting            December 15, 2003

 

Mayor Evangelista called the meeting to order at 7:10 pm and invited all in attendance to join in the Pledge of Allegiance.

 

Council members Mr. Britton, Mr. Buck, Mr. Burgard, Mr. Loparo, Mr. Smith and Mr. Toward were present.  Also in attendance were Administrator Sample, Clerk-Treasurer Reed, Engineer Foley and Chief Matty.  Mayor Evangelista also thanked Township Trustee Pete Wayman for coming tonight. 

 

Mr. Smith motioned to approve the minutes of the December 1, 2003 meeting with an amendment to the Safety Department report.  It should read, “The Auxiliary officers will also distribute gifts to 50 underprivileged Madison Village families for Christmas.”  Mr. Buck seconded.  All present were in favor except Mr. Britton and Mr. Burgard who abstained. 

 

Clerk-Treasurer Reed presented Pay Ordinance #2057 totaling $81,289.27.  Mr. Reed asked that the passage of this Pay Ordinance wait until Ordinance #54-2003 is approved.  Administrator Sample read ORDINANCE #54-2003 for the second time.  AN ORDINANCE PROVIDING FOR ADDITIONAL APPROPRIATIONS AND ADJUSTMENTS TO VARIOUS LINE ITEMS FOR THE CURRENT EXPENSES AND FOR OTHER EXPENDITURES OF THE VILLAGE OF MADISON, OHIO, FOR THE PERIOD BEGINNING JANUARY 1, 2003, TO AND INCLUDING DECEMBER 31, 2003, AND DECLARING AN EMERGENCY.   Mr. Smith motioned to suspend the three reading rule.  Mr. Toward seconded.  All present were in favor.  Mr. Smith motioned for passage of Ordinance #54-2003.  Mr. Buck seconded.  All present were in favor. 

 

Clerk-Treasurer Reed presented Pay Ordinance #2057 totaling $81,289.27. Mr. Toward motioned for approval of Pay Ordinance #2057.  Mr. Britton seconded.  All present were in favor. 

 

 

VISITORS 

 

Nancy Putzke of 63 Eagle Street has two concerns.  The first is the commercial block.  She lives on the west side of Eagle Street, which is residential.  The four family rental units directly across from her, she feels, needs to be addressed.  There is also a commercial building on the alley that is a big eyesore and it is affecting the property values.  The other concern she has might be more time consuming.  It is the number of large trucks that are rattling through Madison Village.  She would like to see them rerouted. 

 

Mr. Mark Vest of 717 West Main Street would like to voice his opposition to Ordinance 57-2003 concerning the residency and also Ordinance 56-2003, the financial officer.  He believes that the change in policy of the existing format of the appointed clerk-treasurer as opposed to the current method is the right way because it is a way of checks and balances and gives people a choice.  He feels that making this a full time position will invite a better caliper of candidates to run for the job.  He believes the public has the intelligence and integrity to decide who would be best to handle their finances.  He also feels that the Village could try harder to find someone within the Village to try to find someone to operate the finances.  

 

Mr. Paul Goda of 431 West Main Street would like clarification of the name parkway lift station as opposed to the pump replacement.  He wanted to know if the plans include maintaining the pumps at the lift station.  Administrator Sample stated that it is an abandonment project but possibly a separate issue of the booster pump at the water tower was confused.  Mr. Goda wanted to know if the signs in town were changed as he noted there is a sign blocking the signal light.  Mayor Evangelista stated that he would make a note of it.

 

Mr. Pete Wayman of 2326 Bennett Road wanted to thank Mr. Ron Smith for being chairman of the Madison Fireboard and for all that he has done.   He thinks Mr. Smith has done more for the Fireboard than anyone in his 12 years of service. 

 

Mr. Jerry Bals of the corner of Middle Ridge and Hubbard Roads has concerns with the new ordinance of unlicensed vehicles. He asked if there is a distinction between commercial and residential vehicles.  He wanted to know if it would be enforced with all vehicles like snowmobiles, campers, mobile homes, and motorcycles.  Brief discussion was held outlining the ordinance. 

 

 

OLD BUSINESS

 

ORDINANCE #36-2003 was read by Administrator Sample. AN ORDINANCE ESTABLISHING THE HISTORIC PRESERVATION DISTRICT AND LISTED PROPERTIES FOR THE VILLAGE OF MADISON, OHIO, AND PROVIDING FOR THE ADMINISTRATION ENFORCEMENT AND AMENDMENT THEREOF, ALL FOR THE PURPOSE OF PROMOTING THE PUBLIC WEALTH, SAFETY, MORAL, COMFORT AND GENERAL WELFARE OF THE RESIDENTS OF THE VILLAGE.  Mr. Toward motioned to remove Ordinance #36-2003 from the table.  Mr. Britton seconded.  All present were in favor. Mr. Loparo motioned to suspend the three reading rule on amended Ordinance #36-2003.  Mr. Buck seconded.  All present were in favor.  Mr. Buck asked for clarification of the boundaries for the audience.  Mr. Murray clarified those boundaries.  Mr. Britton motioned for passage of Ordinance #36-2003.  Mr. Toward seconded.  All present were in favor except Mr. Smith who voted no.   

 

ORDINANCE #53-2003 was read by Administrator Sample for the second time.  AN ORDINANCE AMENDING ORDINANCE #48-1991 SO AS TO ADD NEW SECTION 377.01, 377.02 AND 377.03 TO THE GENERAL TRAFFIC CODE REGULATING THE REGISTRATION AND CONDUCT OF SNOW PLOW OPERATORS.  Brief discussion was held. 

 

ORDINANCE #55-2003 was read by Administrator Sample for the second time.  AN ORDINANCE AMENDING ORDINANCE #33-1996, AS AMENDED, AND THE DISTRICT MAP AND DISTRICT MAP DESIGNATIONS WHICH FORM A PART OF THE ZONING CODE OF THE VILLAGE OF MADISON BY CHANGING THE LAND USE OF AND REZONING PARCEL #2A-8-29 OF REAL PROPERTY LOCATED ON EDWARDS STREET IN MADISON VILLAGE, FROM “M-1” LIMITED INDUSTRY DISTRICT TO “R-3” MULTI-FAMILY DISTRICT.

 

 

NEW BUSINESS

 

ORDINANCE # 56-2003 was read by Administrator Sample for the first time.  AN ORDINANCE CREATING THE POSITION OF VILLAGE FISCAL OFFICER IN ACCORDANCE WITH THE PROVISIONS OF SECTION 733.262 OF THE OHIO REVISED CODE.  Mr. Loparo motioned to suspend the three reading rule.  Mr. Britton seconded.  All present were in favor.  Mr. Loparo motioned for passage of Ordinance #56-2003.  Mr. Britton seconded.  All present were in favor. 

 

ORDINANCE 57-2003 was read by Administrator Sample for the first time.  AN ORDINANCE APPROVING RESIDENCY OUTSIDE THE VILLAGE OF MADISON BY THE VILLAGE FISCAL OFFICER IN ACCORDANCE WITH SECTION 733.262 OF THE REVISED CODE.  Mr. Smith motioned to suspend the three reading rule.  Mr. Britton seconded.  All present were in favor.  Mr. Burgard motioned for passage of Ordinance #57-2003.  Mr. Buck seconded.  All present were in favor. 

 

Solicitor Murray proceeded with the swearing in of Dana Pinkert as Madison Village Fiscal Officer.  Congratulations Dana.

 

ORDINANCE #60-2003 was read by Administrator Sample for the first time.  AN ORDINANCE PROVIDING FOR TEMPORARY APPROPRIATIONS FOR THE CURRENT EXPENSES AND FOR OTHER EXPENDITURES OF THE VILLAGE OF MADISON, OHIO, FOR THE PERIOD BEGINNING ON JANUARY 1, 2004, TO AND INCLUDING MARCH 31, 2004, AND DECLARING AN EMERGENCY.  Mr. Smith motioned for suspension of the three reading rule.  Mr. Burgard seconded.  All present were in favor.  Mr. Smith motioned for passage of Ordinance #60-2003.  Mr. Buck seconded.  All present were in favor. 

 

RESOLUTION #22-2003 was read by Administrator Sample.  A RESOLUTION EXPRESSING APPRECIATION AND GRATITUDE TO RONALD SMITH FOR HIS MANY YEARS OF PUBLIC SERVICE AS COUNCILMAN FOR THE VILLAGE OF MADISON.  Mr. Burgard motioned for passage of Resolution #22-2003.  Mr. Britton seconded.  All present were in favor except Mr. Smith who abstained.

 

RESOLUTION #23-2003 was read by Administrator Sample.  A RESOLUTION EXPRESSING APPRECIATION AND GRATITUDE TO DAVID REED FOR HIS MANY YEARS OF PUBLIC SERVICE.  Mr. Smith motioned for passage of Resolution #23-2003.  Mr. Britton seconded.  All present were in favor. 

 

 

COUNCIL REPORTS

 

Mr. Britton reminisced about the great times with Mr. Smith.  He will also miss David Reed, his “Madison Village’s Mayor” and really appreciated working with him. 

 

Mr. Britton reported that December 6, 2003 was the biggest turnout for Christmas in the Park.  He thanked everyone involved and all for their donations.  It was a great success.  

 

Mr. Toward gave his warmest wishes to Ron and David and asked them to keep in touch.  He also wishes everyone a Merry Christmas and Happy New Year. 

 

Mr. Smith thanked Council and noted that he will still be here to bug them.  He has enjoyed working with everyone, and they have accomplished a lot in his 12 years on Council.  There will be a fireboard meeting in the Township at 7:30 on Wednesday December 17, 2003.

 

Mr. Loparo stated that it has been a pleasure and a learning experience working with Mr. Smith and Clerk-Treasurer Reed.  He also received many positive remarks regarding the Christmas in the Park.  Merry Christmas and a Prosperous New Year to everybody!

 

Mr. Buck stated that it has been great working with David Reed and Ron Smith and he will miss them.  At the December 8, 2003 Planning Commission Meeting, no conditional use permits were issued and no sign permit requests were made.  The did review the site plan for the proposed Reserve at Bear Path Condominiums, but the developer was not present to answer the many questions, so it was tabled.  The next planning commission meeting will be held on January 12, 2004 at 7:00 pm. 

 

Mr. Burgard enjoyed working with Ron and David.  He also wished everyone a Merry Christmas and Happy New Year. 

 

 

ENGINEER’S REPORT

 

Mr. Foley reported that the pump station abandonment is coming along very well. 

 

He thinks that coming to a Council Meeting without David will be a new experience for him.  Since 1987, in one fashion or another, David has been here.  Mr. Foley thinks highly of him and thanks him for his support over the years. 

 

Mr. Foley will also miss Ron Smith.  He has worked with him in the Fire district for many years.  He wishes them both well and thanked them. 

 

 

SAFETY DEPARTMENT

 

Chief Matty reported that two mobile data recorders were installed over the weekend.  The new equipment assisted with four warrant apprehensions over sixteen hours of use. 

 

He thanked Ron Smith and David Reed on behalf of the Safety department and himself, for their years of dedicated support.

 

 

ADMINISTRATOR’S REPORT

 

Administrator Sample stated that he would like to see legislation expressing appreciation to the military for the capture of Saddam Hussein. 

 

He also stated that in light of January, February and March eating up much of the salt budget of this year, we have been fortunate in November and half of December in not needing much salt. 

 

He stated that having the great fortune to work with David and Ron has accomplished many great things in the Village of Madison. They have both made income tax decisions that will affect the Village for many years to come. 

 

 

MAYOR’S REPORT

 

Mayor Evangelista stated that as of January 1, 2004 he has an opening on the Board of Zoning Appeals and will be accepting resumes.  He stated that he did have an opening on Planning Commission, but Mr. Smith has filled that position. 

 

Some upcoming dates include:  December 18, 2003 will be the next Mayor’s Court; December 25, 2003, of course, is Christmas; January 5, 2004 will be the re-organizational meeting with the swearing in of Mayor Evangelista and two Council members; and January 12, 2004 will be the next Planning Commission meeting. 

 

Mr. Britton motioned to adjourn to Executive Session for personnel.  Mr. Buck seconded.  All present were in favor. 

 

Motion made to return to Regular meeting at 9:30 pm by Mr. Burgard.  Mr. Smith seconded.  All present were in favor.    

 

ORDINANCE #58-2003 was read by Administrator Sample for the first time.  AN ORDINANCE ESTABLISHING THE HOURS OF WORK AND RATE OF PAY FOR VARIOUS MUNICIPAL EMPLOYEES OF THE VILLAGE OF MADISON.  Mr. Britton motioned for suspension of the three reading rule.  Mr. Toward seconded.  All present were in favor.  Mr. Britton motioned for passage of Ordinance #58-2003.  Mr. Smith seconded.  All present were in favor except Mr. Burgard who abstained. 

 

ORDINANCE #59-2003 was read by Administrator Sample for the first time.  AN ORDINANCE ESTABLISHING THE HOURS OF WORK AND RATE OF PAY FOR ALL MEMBERS OF THE SAFETY FORCES OF THE VILLAGE OF MADISON.  Mr. Smith motioned for suspension of the three reading rule.  Mr. Burgard seconded.  All present were in favor.  Mr. Buck motioned for passage of Ordinance #59-2003.  Mr. Britton seconded.  All present were in favor. 

 

Mr. Smith motioned to adjourn at 9:45 pm.  Mr. Burgard seconded.  All present were in favor.
