Mayor Evangelista called the Public Hearing to order at 6:45 pm. Council members Mr. Buck, Mr. Loparo, Mr. Smith, and Mr. Toward were present. Mr. Britton and Mr. Burgard were absent.
The purpose of the Public Hearing was to hear written or oral comments on a request by Mr. Kirk Betteley to rezone 9.87 acres of Parcel 2A-18 from M-1 limited industry to R-3 multi-family. This parcel is just off Edwards Street and connects to Sweet Briar.
Mr. Ralph Korb of 724 Coralberry Lane expressed concern about the trees abutting his property, the use of the retention pond, and the increased number of cars in the development. Mr. Kirk Betteley was available to respond to his concerns.
A traffic study requested by Mr. Vest and Mr. Buck of the Planning Commission revealed that the plans submitted by the developer would have no significant impact to the intersection of North Lake Street.
Elizabeth Porcello of 124 Woodbine Oval stated that the alternative would be to have the property remain zoned as light industry. She does not want to be living next to any type of industry. She feels it would be a fine addition to have more housing built and to have the development continue.
Mr. Toward motioned to adjourn at 6:58 pm. Mr. Smith seconded. All present were in favor.
Mayor Evangelista called the meeting to order at 7:05 pm and invited all in attendance to join in the Pledge of Allegiance.

Mr. Smith motioned to approve the minutes of the November 18, 2002 meeting. Mr. Buck seconded. All present were in favor.
Clerk-Treasurer Reed presented Pay Order #2033 totaling $58,121.52. Mr. Buck motioned for approval. Mr. Toward seconded. All present were in favor.

ORDINANCE #43-2002 was read by Solicitor Murray for the second time. AN ORDINANCE ESTABLISHING THE HOURS OF WORK AND RATE OF PAY FOR VARIOUS MUNICIPAL EMPLOYEES OF THE VILLAGE OF MADISON.
ORDINANCE #44-2002 was read by Solicitor Murray for the second time. AN ORDINANCE ESTABLISHING THE HOURS OF WORK AND RATE OF PAY FOR ALL MEMBERS OF THE SAFETY FORCES OF THE VILLAGE OF MADISON.
NEW BUSINESS
ORDINANCE #46-2002 was read by Solicitor Murray for the first time. AN ORDINANCE PROVIDING FOR ADDITIONAL APPROPRIATIONS AND ADJUSTMENTS TO VARIOUS LINE TIMES FOR THE CURRENT EXPENSES AND FOR OTHER EXPENDITURES OF THE VILLAGE OF MADISON, OHIO, FOR THE PERIOD BEGINNING JANUARY 1, 2002, TO AND INCLUDING DECEMBER 31, 2002, AND DECLARING AN EMERGENCY.
ORDINANCE #47-2002 was read by Solicitor Murray for the first time. AN ORDINANCE AMENDING ORDINANCE NO. 33-1996, AS AMENDED, AND THE DISTRICT MAP AND DISTRICT MAP DESIGNATIONS WHICH FORM A PART OF THE ZONING CODE OF THE VILLAGE OF MADISON BY CHANGING THE LAND USE OF AND REZONING CERTAIN PARCELS OF REAL PROPERTY LOCATED IN THE SWEET BRIAR SUBDIVISION IN MADISON VILLAGE, FROM “M-1” LIMITED INDUSTRY TO “R-3” MULTIPLE FAMILY RESIDENCE DISTRICT.
RESOLUTION #34-2002 was read by Solicitor Murray for the first time. A RESOLUTION ACCEPTING THE DONATION OF ONE CHRISTMAS TREE FOR USE BY MADISON VILLAGE AND EXPRESSING APPRECIATION AND GRATITUDE TO JOHN SAMPLE THEREFORE. Mr. Toward motioned to accept Resolution #34-2002. Mr. Smith seconded. All present were in favor.
A DISCUSSION FOR A RESOLUTION ASKING FOR TAX MONEY OWED TO MADISON VILLAGE SCHOOLS TO BE RETURNED. Mr. Buck explained that between 1992 and 1995, Carter Lumber’s personal property tax was misallocated to Madison School district that is outside of Columbus. They have refused to give the $50,000 back. With interest it amounts to $87,000. It has gone to court and our Madison Local School District won the first round and the other Madison School District appealed it. Our District appealed it to the Supreme Court, but the Supreme Court will not hear the case. Mr. Buck suggested Council pass a resolution to try to get the funds back for Madison Village students. Mr. Buck made a motion for Solicitor Murray to word a resolution to get the funds back. Mr. Smith seconded. All present were in favor.
RESOLUTION #36-2002 IS A RESOLUTION ACCEPTING A $500.00 DONATION FROM HARVEY HUBBELL CORPORATION. Mr. Toward motioned to accept Resolution #36-2002. Mr. Buck seconded. All present were in favor.
Mr. Toward reported that the meeting with the company to paint the water tower did not happen as scheduled. However, it did happen prior to this meeting. A gentleman climbed the water tower and actually went inside it. A quote from him is expected some time soon. Mr. Toward also received a quote from another company to just paint the tank and roof, would cost $52,000. To have the legs painted would cost an additional $40,000. This is much more than expected.
Mr. Toward also wanted to compliment the crews that the Village Park looks great, the Railroad Station looks nice, the music is on and it is a very nice atmosphere.
Mr. Smith reported that there is a Fire Board Meeting on December 4, 2002 at 7:30 pm in the Village Hall.
Mr. Buck reported that there is a Planning Commission Meeting on December 9, 2002 at 7:00 pm.

Chief Matty reported that Sergeant Verdi has given him an update on the Community Policing Christmas Project. “Christmas with Madison Village Police Department” is the theme and gifts for 21 needy children in the area have been sponsored. The gifts will be wrapped and distributed by Sergeant Verdi and the auxiliary officers during the week of Christmas.
The Protect and Serve Tavern with the Lake County Crime Task force will be December 7, 2002 at the Great Lakes Mall. Also, manpower for the Madison Old Fashioned Days Christmas in the Park on December 7, 2002 is all set.
Chief Matty also reported that Patrolman Craig Anderson of Willoughby Hills gave a 3-hour training class. It was a class on the new Ohio accident report that requires Supervisors to sign off on each accident report. There were 3 Officers in attendance.

Mayor Evangelista commented that the road crews were doing a great job with snow removal. Because of the snow, the Christmas decorations are a little behind schedule but will soon be caught up.
Mayor Evangelista reminded Council on behalf of Mr. Britton that the parade will begin at 5:30pm on Saturday, December 7 for the Madison Old Fashioned Days Christmas in the Park-and Santa will be there!
Administrator Sample and Mayor Evangelista met with Commissioner Dan Troy regarding the recycling program. They were informed that it is an un-funded mandate. Madison Village must participate in a recycling program.

Mayor Evangelista distributed unapproved copies of the minutes of the Senior Board so that Council could be kept abreast of what is happening at the Senior Center.
Some upcoming dates include: December 7, 2002 is Old Fashioned Days, Christmas in the Park, December 9, 2002 is the next Planning Commission, December 16, 2002 is the next regular Council Meeting and December 5 and 19, 2002 will be the next 2 Mayors Court.
Mayor Evangelista presented a Dedication Plaque from the Madison Senior Center from 1996. Plans for a program of presentation are up coming.
