Minutes of Madison Village Meeting held June 10, 2002

 

 

Regular Meeting            June 10, 2002

 

Mayor Evangelista called the meeting to order at 6:04 pm and invited all in attendance to join in the Pledge of Allegiance.

 

Council Members Mr. Britton, Mr. Buck, Mr. Loparo, Mr. Smith and Mr. Toward were present.  Also in attendance were Administrator Sample, Clerk-Treasurer Reed, Solicitor Murray, Eric Haibach, and Chief Matty.

 

Mr. Smith motioned to approve the minutes of the Regular Meeting on May 20, 2002.  Mr. Loparo seconded.  All present were in favor, except Mr. Burgard who abstained.

 

Clerk-Treasurer Reed presented Pay Order #2025 totaling $148,924.04.  Mr. Burgard motioned for approval.  Mr. Britton seconded.  All present were in favor.

 

 

VISITORS

 

Mike Gehring a Representative of the Madison-Perry Area Chamber of Commerce and lifelong resident stated that he is in favor of the proposed study. He also presented a letter from the Madison-Perry Area Chamber of Commerce encouraging Council to support the proposed study to realign a portion of Route 528 to include an underpass.

 

Mary Lou McCracken a Madison Township resident and former Madison Township Trustee stated her support of the proposed study.

 

Michael Loparo of 27 Saxton Street and owner of several businesses in the Village stated that she is against the study being done in the Village.  She feels there may be another location for this to take place.

 

Nancy Putzke of 63 Eagle Street feels she represents her street in stating that is would sorely impact her street. She feels that another location can be as efficient if not more so than the one in the Village. 

 

Eileen Findak of a business at 30 W. Main Street and residence at 248 Bates Rd. is in favor of the study in a positive way.  She feels it would help bring business into the Village with a clear shot into town.

 

Joyce Reney of 190 Manchester Court and also from the business of Nifty Fifty Resteraunt is not in favor of the study. 

 

Don Adams of Davey Court is concerned with what happens to the residents on Edwards Street and Route 528.  They may have purchased their homes because of the ‘nice, quiet community’.  He feels there is no need to change the character of the entire Village to benefit those on the north side of Madison. He hopes that if the study does go forward, it is found to be a bad idea.

 

Ward Buck of 885 W. Main Street and long time resident of Madison.  In the last ten years there has been 50 % growth.  He feels the study is very important for the future of this Village.  He sees it as a benefit to both the north and south side of the tracks.  The study will answer a lot of questions.

 

Chuck Paine of J. C. Nifty Fifty Restaurant wants to know what will happen to the businesses in his building.  He is against the study.  He feels the money should be spent improving the parking situation in the Village.

 

 

APPOINTMENT

 

Officer Kurt Svagerko was appointed to a Part time police patrolman position.  Congratulations to Officer Svagerko.

 

 

OLD BUSINESS

 

ORDINANCE # 25-2002 was read by Administrator Sample for the second time.  AN ORDINANCE AUTHORIZING AND DIRECTING THE VILLAGE ADMINISTRATOR AND CLERK-TREASURER TO ENTER INTO AN AGREEMENT WITH MADISON TOWNSHIP TRUSTEES AND THE LAKE COUNTY ENGINEER FOR THE PURPOSE OF PREPARING A STUDY FOR AN EXTENSION AND RAILROAD UNDERPASS FOR STATE ROUTE 528 THROUGH THE VILLAGE OF MADISON. Mr. Loparo motioned for suspension of the three reading rule.  Mr. Smith seconded.  All were not in favor.  Discussion followed with Mr. Loparo asking the County Engineer, Mr. Gills, to speak.  He stated that the County is anxious to do what the Village Council wishes.  The funding has been discussed and with the sharing of funds from the Township, the County and the Village, the study can proceed if that is what Village Council recommends.  He feels that honestly, the Village needs to do the study to see what the Village could lose and what it will not lose.  However if the Village is not comfortable with the study, that is fine too.  Growth is coming and Route 20 will be improved.  With those improvements brings more traffic.  Along with this study, the next step would be a very detailed environmental review looking at the endangered species, and the historical significance of the Village.  The Ohio State Historical Society will not allow a road to be built to destroy the Historical significance of the Village.  The County is here to support the Village either way. 

 

Administrator Sample had a brief discussion with Engineer Gills regarding the businesses this would affect and the cost.  Mr. Gills also noted that this study would take a long time. 

 

Mr. Loparo commented that he feels that this Council is in favor of a study, not particularly at the specific location it is being presented. He has spoken to Paul of the Laundromat and Mr. Writt of NEO Insurance.  They are both concerned with this study, but both would hope to relocate within the Village with a little help in finding a location.

 

Mr. Loparo read a letter to Congressman LaTourette describing the underpass proposal and asking his opinion of the study.   He received a response from Steven C. LaTourette on May 31.  Mr. LaTourette stated in his letter that he believes such a project would be worthy of consideration.  He stated that because of the division of opinion by the local government, he has been happy to sit on the sidelines until the matter is resolved. The Councilmen and Trustees and Citizens of Madison need determine if such a project is wanted, and if that should be the decision, he is willing to use the influence of his office to help secure the funding.  He has not endorsed any specific plan or proposal.  He believes that sites need to be determined by a feasibility study and the local government working in conjunction with O.D.O.T. 

 

Mr. Smith stated that there is confusion in the cost of this study.  He had the understanding in the beginning that this study had no cost, but he also knows that if it sounds too good to be true, it is.  He is not against the study, but believes it is in the wrong location.

 

Mr. Buck stated that he never said that Mr. LaTourette agreed to this site.  He stated that Mr. LaTourette agreed that the Village needs to do study, but not with a specific location.  Mr. Buck has a list of 31 businesses in favor of a study to extend Route 528 to include a railroad underpass.  He also has a list of 7 business owners who do not approve of the study to extend Route 528 to include a railroad underpass and 3 business owners who were not for or against the study and 2 business owners that were unavailable.

 

Mr. Burgard commented that he is in favor of this study. 

 

Susan Quail of 715 W. Main St. noted that this is only a study to see if this is feasible. She stated that this is not set in stone, as there are no plans drawn up yet.  Without a study, we won’t know if it is feasible. 

 

Mike Gehring commented on the letter from the Madison-Perry Area Chamber of commerce in support of the study.

 

Roy Blalock of 4099 Dayton Rd. stated he thinks the biggest problem is state funding.  If the Village can’t get state funding for the underpass, it can’t be put anywhere else.  He feels that once Sidley comes in, we will have to grow. 

 

Don Adams of 979 Davey Court believes that all of Madison should be studied.  He thinks that a highway bypass might be a possibility to keep the business district intact.  There are many possibilities.

 

Lee Fairchild of 750 W. Main Street is concerned about the money.  He thinks a broad study should be done, not the specific study that is proposed.  He feels since 9-11 there are many more important issues to deal with such as the police department, fire department, and rescue units that could use more equipment to better deal with the inconvenience of the railroad tracks. 

 

Mayor Evangelista urged the public to contact their Councilman to let them know their feelings on this and other issues. 

 

Mr. Buck stated that we could look at other locations for the study, but why spend $75,000 on other routes that are not viable.  Those would only lead traffic out of town not into town. 

 

Mr. Britton motioned to approve Ordinance 25-2002.  Mr. Loparo seconded.  The ordinance fails for lack of majority. 

 

 

NEW BUSINESS

 

ORDINANCE #26-2002 was read by Administrator Sample for the first time.  AN ORDINANCE PROVIDING FOR ADDITIONAL APPROPRIATIONS AND ADJUSTMENTS TO VARIOUS LINE ITEMS FOR THE CURRENT EXPENSES AND FOR OTHER EXPENDITURES OF THE VILLAGE OF MADISON, OHIO, FOR THE PERIOD BEGINNING JANUARY 1, 2002, TO AND INCLUDING DECEMBER 31, 2002, AND DECLARING AN EMERGENCY. 

 

 

COUNCIL REPORTS

 

Mr. Britton wanted to congratulate Chuck Payne on the car show.  He had 53 cars for the car show which was a good turn out.  He also wanted to congratulate the concerts in the park.  They had a pretty good turn out for the rainy, cold weather that they had. 

 

Mr. Toward agreed with Mr. Britton on the car show.  He thinks it will be a good thing to get people into town. 

 

Mr. Smith reported there would be a Fire Board Meeting at Madison Township Safety Center on June 19, 2002 at 7:30 pm.

 

Mr. Loparo wanted to thank Mr. Sample for being a good Village Administrator.

 

Mr. Buck reported that he attended M.A.D.C. meeting on May 23, 2002.  The next meeting will be June 20, 2002 at the Madison Public Library at 6:30 pm. 

 

Mr. Burgard thanked Mr. Buck for his work on the study.

 

 

ENGINEER’S REPORT 

 

 

Eric Haibach reported that a water line is being installed in the Sidley subdivision.  Also last year’s waterline patches in the street will be remedied as soon as possible.

 

 

 

SAFETY DEPARTMENT REPORT

 

Chief Matty thanked Council for the appointment of Kurt Svagerko. 

 

Chief Matty also presented the resignation of Officer Brennan.  Mr. Britton motioned to accept the resignation of Officer Brennan.  Mr. Toward seconded.  All present were regretfully in favor. 

 

Chief Matty announced that safety town will start on the 17th and will be a 2-week program.  It will be held at Madison Middle School.

 

Lake County Narcotics Agency will be presenting a training session for officers in conjunction with Madison Township and Perry Village Police Departments.  It will be held at the Manchester West Training Center in Perry. 

 

Chief Matty requested authorization to attend the 2002 Ohio Association of Chiefs of Police Conference to be held in Sandusky on July 9-12.  Mr. Britton motioned to authorize his attendance.  Mr. Smith seconded.  All present were in favor. 

 

 

ADMINISTRATOR’S REPORT

 

Administrator Sample reported the sidewalk program is continuing. 

 

He announced that the Village received an anonymous check in the amount of $1,000 to help with the replacement program for old cemetery markers.  Council will pass a resolution for that purpose.

 

After Ordinance #26-2002 was read, Clerk-Treasurer Reed noted that some of the items in that ordinance would need to be addressed tonight.  The purchase agreement will be signed soon and the funds need to be available. Ordinance #26-2002 will be amended to include only what is needed at the time, to include the acquisition of the land and to repair the sewer pumps.  Mr. Burgard motioned to suspend the three reading rule.  Mr. Loparo seconded.  All present were in favor.  Mr. Burgard motioned for passage of Amended Ordinance #26-2002.  Mr. Buck seconded.  All present were in favor.

ORDINANCE #27-2002 was read by Administrator Sample for the first time.  AN ORDINANCE PROVIDING FOR ADDITIONAL APPROPRIATIONS AND ADJUSTMENTS TO VARIOUS LINE ITEMS FOR THE CURRENT EXPENSES AND FOR OTHER EXPENDITURES OF THE VILLAGE OF MADISON, OHIO FOR THE PERIOD BEGINNING JANUARY 1, 2002, TO AND INCLUDING DECEMBER 31, 2002, AND DECLARING AN EMERGENCY. 

 

Resolution #28-2002 to accept from an anonymous donor a check in the amount of $1,000 to be used to help with the replacement program for old cemetery markers.  Mr. Loparo motioned for passage of Resolution #28-2002.  Mr. Toward seconded.  All present were in favor. 

 

 

MAYOR’S REPORT

 

Mayor Evangelista reported that Rae Jean Burgard was successful in obtaining $6,000 from United Way to help with the Senior Center. 

 

The position on the Board of Zoning Appeals is still open.  If anyone is interested, please notify Mayor Evangelista.

 

The Stormwater Management Plan, a federal Government program has requested the Village to be part of a study for Arcola Creek. 

 

Mayor Evangelista commented that the Cruising Tuesdays car show and Concert in the park were two successful events in the Village. 

 

Mayor Evangelista notified residents that on June 11 the mosquito truck would be in Madison spraying for mosquitoes.

 

The Planning Commission Meeting scheduled for tonight has been cancelled.  Upcoming dates that include June 14, 2002 at noon will be the Lake County Economic Development Luncheon at Dino’s, June 12 is United Way Day of Caring, July 8, 2002 at 7:00 pm will be the next Planning Commission Meeting and July 15, 2002 at 7:00 pm will be the next Regular Council Meeting.

 

Council Members will adjourn to executive session for the purpose of Personnel and Legal.  There will be no business after this session. 

 

Mr. Smith motioned for adjournment at 9:06 pm.  Mr. Britton seconded.  All present were in favor.
