VILLAGE OF MADISON
Regular Meeting
June 14, 2004
Mayor Evangelista called the meeting to order at 7:05 p.m. and invited all in attendance to join in the Pledge of Allegiance to the American Flag.
Council members Mr. Britton, Mr. Buck, Mr. Burgard, Mr. Loparo, Mr. Toward and Mr. Vest were present. Also in attendance; Mayor Evangelista, Administrator Sample, Solicitor Murray, Fiscal Officer Pinkert and Police Chief Matty.
Motion by Mr. Britton, seconded by Mr. Burgard, to approve the minutes of the regular meeting on June 7, 2004, as presented. Roll call on the motion, 5 yeas and 1 abstain (Mr. Loparo).
Fiscal Officer Pinkert presented Pay Ordinance #2070 totaling $206,580.92 for current and upcoming expenses. Motion by Mr. Burgard, seconded by Mr. Vest, to approve Pay Ordinance #2070. Roll call on the motion, 6 yeas. Motion passed.
RESOLUTION NO. 12-2004 was read by Administrator Sample. A RESOLUTION DESIGNATING PATROLMAN THURSTON “CURT” SVAGERKO AS THE RECIPIENT OF THE ANNUAL MADISON VILLAGE “JOHN M. WARNER MEMORIAL POLICE OFFICER OF THE YEAR AWARD. Motion by Mr. Britton, seconded by Mr. Loparo, to approve Resolution No. 12-2004. Roll call, 6 yeas. Resolution No. 12-2004 duly adopted.
Mayor Evangelista read a brief passage from the resolution informing everyone that Officer Svagerko recently assisted in apprehending a bank robber and presented Patrolman Svagerko with the Resolution and a plaque for his designation of “Police Officer of the Year”.
RESOLUTION NO. 13-2004 was read by Administrator Sample. A RESOLUTION DESIGNATING AUXILIARY OFFICER DOUGLAS COVERT AS THE RECIPIENT OF THE ANNUAL MADISON VILLAGE POLICE “AUXILIARY OFFICER OF THE YEAR” AWARD. Motion by Mr. Loparo, seconded by Mr. Toward, to approve Resolution No. 13-2004. Roll call, 6 yeas. Resolution No. 13-2004 duly adopted.
Mayor Evangelista read a brief passage from the resolution informing everyone that Auxiliary Officer Covert also assisted in apprehending the bank robber and presented Auxiliary Officer Covert with the resolution and a plaque for his designation of “Auxiliary Officer of the Year”.
Jack Laden, 104 W. Main Street, said that the car shows are going good but unfortunately, people are not cleaning up after their dogs and it is becoming a problem in the park. Mr. Loparo said the he has witnessed people leaving their dog’s mess and that citations should be issued to them. Police Chief Matty said that the Village does have a scoop ordinance but, unfortunately it is hard to enforce. Mayor Evangelista suggested everyone keep their eyes open in order to help enforce the ordinance.
Chief Matty informed everyone that Patrolman Svagerko recently completed non-lethal weapon instructor training and has a presentation on the “taser”, a non-lethal weapon. Patrolman Svagerko gave a presentation about the taser and answered questions from Council.
ORDINANCE NO. 19-2004 was read by Administrator Sample, tabled. AN ORDINANCE ACCEPTING THE BID OF SWEET BRIER II BUILDING COMPANY FOR THE SALE OF A PARCEL OF REAL ESTATE IN MADISON VILLAGE AND AUTHORIZING AND DIRECTING THE VILLAGE ADMINISTRATOR AND FISCAL OFFICER TO EXECUTE A REAL ESTATE AGREEMENT AND DECLARING AND EMERGENCY.
Solicitor Murray said that Sweet Brier has signed the contract that was put forth and recommended the ordinance be removed from the table. Motion by Mr. Burgard, seconded by Mr. Loparo, that Ordinance No. 19-2004 be removed from the table. Roll call, 6 yeas. Motion passed. Motion by Mr. Loparo, seconded by Mr. Buck, to approve Ordinance No. 19-2004. Roll call, 6 yeas. Ordinance No. 19-2004 duly approved.
Mr. Vest asked about the designation of the money from the sale of the property and requested some of it be used to provide electricity in order to light the flag at the Senior Center. Administrator Sample explained that it has to go into the general fund and Council can designate it from there. Mayor Evangelist a said that there is already a project in the works for electricity that could light the flag at the Senior Center.
ORDINANCE NO. 37-2004 was read by Administrator Sample, third reading. AN ORDINANCE AUTHORIZING AND DIRECTING THE SUBMISSION TO THE ELECTORS OF THE VILLAGE OF MADISON, OHIO A REFERENDUM RELATING TO THE CONTINUED TAXATION OF A SHAREHOLDER’S DISTRIBUTIVE SHARE OF NET PROFITS FROM AN ‘S’ CORPORATION.
Administrator Sample said that this issue was passed last year but not submitted to the County in time to get it on the ballot and that it would generate about $5,000. Solicitor Murray explained that in order for the Village to continue to collect this tax, the issue has to be put on the ballot for approval.
Mr. Toward said that it would be important to inform the voters about the issue. Mr. Vest and Mr. Loparo expressed concerns about the issue penalizing and discouraging business in the Village. Mr. Britton supported the issue.

SCHOOL RESOURCE OFFICER
Administrator Sample gave an update on the meeting regarding the School Resource Officer (SRO) position. Administrator Sample said that although the school is still looking for a financial commitment from the Village his recommendation would be not to make a formal agreement but to wait until the end of 2004 and make a donation based on the available resources. Council supported Administrator Sample’s recommendation.
ORDINANCE NO. 41-2004 was read by Administrator Sample, first reading. AN ORDINANCE AUTHORIZING AND DIRECTING THE VILLAGE ADMINISTRATOR AND FISCAL OFFICER TO RESCIND THE CONTRACT WITH WORLD RESOURCES, INC. FOR ITS DEFAULT OF THE CONTRACTUAL OBLIGATIONS AND DECLARING AN EMERGENCY.
Motion by Mr. Britton, seconded by Mr. Loparo, to suspend the three reading rule for Ordinance No. 41-2004. Roll call, 6 yeas. Motion passed. Motion by Mr. Toward, seconded by Mr. Britton, to approve Ordinance No. 41-2004. Roll call, 6 yeas. Ordinance No. 41-2004 duly passed.
ORDINANCE NO. 42-2004 was read by Administrator Sample, first reading. AN ORDINANCE CONFIRMING THE FINAL APPOINTMENT OF REBECCA BROZAK AS A PART-TIME PATROL OFFICER FOR THE MADISON VILLAGE POLICE DEPARTMENT, AND DECLARING AN EMERGENCY.
Motion by Mr. Toward, seconded by Mr. Buck, to suspend the three reading rule for Ordinance No. 42-2004. Roll call, 6 yeas. Motion passed. Motion by Mr. Burgard, seconded by Mr. Toward, to approve Ordinance No. 42-2004. Roll call, 6 yeas. Ordinance No. 42-2004 duly passed.
ORDINANCE NO. 43-2004 was read by Administrator Sample, first reading. AN ORDINANCE AUTHORIZING AND DIRECTING THE VILLAGE ADMINISTRATOR AND FISCAL OFFICER TO ENTER INTO A CONTRACT WITH WASTE MANAGEMENT FOR THE COLLECTION, HAULING AND DISPOSAL OF RESIDENTIAL GARBAGE AND REFUSE IN MADISON VILLAGE.
Administrator Sample explained that the agreement is for the balance of a three year term (2 years) and will take effect July 23, 2004. He added that the collection day will be Friday and residents will be notified with notices in their water/sewer bills and door to door notices.

ORDINANCE NO. 44-2004 was read by Administrator Sample, first reading. AN ORDINANCE DETERMINING TO PROCEED WITH THE IMPROVEMENT OF STREETS IN THE VILLAGE OF MADISON, OHIO, BY SUPPLYING THE SAME WITH ELECTRIC STREET LIGHTING, AND DECLARING AN EMERGENCY.
Administrator Sample said that the assessment is dropping from 1.6 to 1.4 mils.

ORDINANCE NO. 45-2004 was read by Administrator Sample, first reading. AN ORDINANCE LEVYING ASSESSMENTS FOR THE IMPROVEMENT OF STREETS IN THE VILLAGE OF MADISON, OHIO, BY SUPPLYING SAME WITH ELECTRIC STREET LIGHTING, AND DECLARING AN EMERGENCY.
Motion by Mr. Loparo, seconded by Mr. Vest, to suspend the three reading rule for Ordinance No. 45-2004. Roll call, 6 yeas. Motion passed. Motion by Mr. Loparo, seconded by Mr. Burgard, to approve Ordinance No. 45-2004. Roll call, 6 yeas. Ordinance No. 45-2004 duly passed.
ORDINANCE NO. 46-2004 was read by Administrator Sample, first reading. AN ORDINANCE AMENDING THE GENERAL TRAFFIC CODE TO REGULATE THE STORAGE OF UNLICENSED MOTOR VEHICLES, AMENDING SECTION 351.14 AND DECLARING AN EMERGENCY.

ORDINANCE NO. 47-2004 was read by Administrator Sample, first reading. AN ORDINANCE ESTABLISHING RATES TO BE CHARGED FOR GARBAGE DISPOSAL SERVICE AND DECLARING AN EMERGENCY.

Mr. Britton expressed concerns about garage sale signs not being removed after a sale and suggested charging a fine to residents if the Village crews have to remove their signs.
Mr. Britton also expressed concerns about people parking across the sidewalks, specifically on Dayton Rd.
Mr. Britton said that there is a Fire Board meeting Wednesday June 16, 2004, at 7:30 pm.
Mr. Toward asked Chief Matty about licenses for scooters. Chief Matty explained that most scooters don’t have enough horsepower to require a license.
Mr. Vest encouraged everyone to be aware of the children now that school is out.

Mr. Buck said that Main Street looks nice with the flags and flowers.
Mr. Burgard expressed concerns about the sewer back-up at Mr. Mather’s house and asked if the issue needs further investigation. Administrator Sample said that the laterals have been televised and that the back-ups at the Mather’s house were two isolated incidents.

Police Chief Matty reported the following:
Safety town started today and will last two weeks.
Most of the department completed Firearms Training at Lakeland Community College.
Patrolman Eisenhart said that the training was beneficial and that he would like to have it every 6 mos.
Administrator Sample reported the following:
The Village work crews did an excellent job preparing the Village for Memorial Day.
Brush pick-up started today.
There was a water main break last week. A representative from National Waterworks delivered a tap sleeve and assisted Village work crews until about 4:00 am. He added that there was a boil alert and the recommended testing and reports were completed.
Flow meter data is available with Hyder Drive having over 72,000 gallons in a 24 hour period in a major rain event and parkway coming out okay. The Village will be doing some smoke testing to identify any problems.
Mayor Evangelista reported the following:
The Village crews and Police did an excellent job for Memorial Day.
Fiscal Officer Pinkert has been employed with the Village for 6 months and per ordinance will receive a pay adjustment.
Potbelly’s has applied for a liquor license.
