RECORD OF PROCEEDINGS
Mayor Evangelista called the meeting to order at 6:35 pm and invited all in attendance to join in the Pledge of Allegiance.
Council Members Mr. Burgard, Mr. Buck, Mr. Loparo, Mr. Smith and Mr. Toward were present. Mr. Britton arrived at 6:45 pm. Also in attendance were Clerk-Treasurer Reed, Administrator Sample, Chief Matty, and Engineer Foley.
Clerk-Treasurer Reed presented amended Pay Order No. 2020 totaling $24,891.11. Mr. Loparo motioned for approval. Mr. Toward seconded. All present were in favor.
Mr. Jack Lading of 603 West Main Street presented his concerns on the proposed sewer project. Administrator Sample discussed some of the particulars on this project regarding the grant that the Village will receive. Mr. Lading expressed concern with the equipment that will be used for this project and asked specifically what equipment would be used. Administrator Sample responded that a truck, trailer, backhoe and front-end loader are typically used for this type of project. As Mr. Lading was concerned of destruction to his property, Administrator Sample assured him that restoration would be made should any damage take place. A lengthy discussion followed. Mr. Lading also expressed his concern of Madison Village turning into “Mentor”.
Mrs. Toth of 637 West Main Street expressed concerns of kids trespassing on the rear of her property. Her son, Scott Toth also expressed concerns of trespassing. Mayor Evangelista asked Chief Matty to note her address and to be aware of the problem.
Mr. Jeff Savage of 591 West Main Street has lived in the Village for about 3 years. His concern is the legal right of the Village to dig on people’s property, the natural waterway, and the EPA. Administrator Sample noted that there would need to be 2 easements to access the sewer project. Discussion followed.
Charles Crusic does not live in the Village, but travels through the Village often. His concern is the parallel parking being too close to traffic in the Village. Administrator Sample will present this concern to the traffic engineer.
Mr. Lading requested that Administrator Sample and possibly Mr. Foley walk the property with him and explain what will be involved in the sewer project.
Scott Orris of 635 West Main Street expressed concern of property owners being involved and knowing the options available in this project. He is also concerned about using the low bid contractor. He feels his property was not restored to where it should have been when the new water lines went through his front yard.
Mayor Evangelista noted that property owners would be advised of any advancement on this project.
ORDINANCE #5-2002 was read by Administrator Sample for the third time. AN ORDINANCE MAKING APPROPRIATIONS FOR CURRENT EXPENSES AND OTHER EXPENDITURES OF THE VILLAGE OF MADISON, STATE OF OHIO, DURING THE FISCAL YEAR ENDING DECEMBER 31, 2002. Administrator Sample explained 2 amendments to Ordinance #5-2002. The first is the Safety Fund. The bid on the new S.U.V. was $4,500 under the projected amount and that will be adjusted accordingly. The second amendment is adjusting funds from the Senior Operating Fund into the Senior Center Capital Fund. Mr. Smith motioned to amend Ordinance #5-2002. Mr. Burgard seconded. ORDINANCE #6-2002 was read by Administrator Sample for the third time. AN ORDINANCE AMENDING ORDINANCE NO. 48-1994, SECTIONS 7,8,24, AND 27, AS TO MODIFY THE RATES TO BE CHARGED FOR WATER AND WATER SERVICES AND DECLARING AN EMERGENCY. Mr. Smith motioned for passage of Ordinance #6-2002. Mr. Buck seconded. All present were in favor.
ORDINANCE #7-2002 was read by Administrator Sample for the second time. AN ORDINANCE AMENDING ORDINANCE NO. 49-1994, SECTIONS 4B, 11, AND 12 AS TO MODIFY THE RATES TO BE CHARGED FOR SANITARY SEWERAGE SERVICE AND DECLARING AN EMERGENCY. Mr. Loparo motioned for suspension of the three reading rule. Mr. Burgard seconded. All present were in favor. Mr. Loparo motioned for passage of Ordinance #7-2002. Mr. Buck seconded. ORDINANCE #8-2002 was read by Administrator Sample for the second time. AN ORDINANCE AUTHORIZING AND DIRECTING THE VILLAGE ADMINISTRATOR AND CLERK-TREASURER TO ENTER INTO A CONTRACT WITH GEHRING’S AGENCY, INC. ON BEHALF OF GENERAL STAR NATIONAL INDEMNITY COMPANY FOR LAW ENFORCEMENT LIABILITY INSURANCE FOR MADISON VILLAGE AND DECLARING AN EMERGENCY. ORDINANCE #9-2002 was read by Administrator Sample for the second time. AN ORDINANCE AUTHORIZING AND DIRECTING THE VILLAGE ADMINISTRATOR AND CLERK-TREASURER TO ENTER INTO A CONTRACT WITH GEHRING’S AGENCY, INC. ON BEHALF OF WESTFIELD INSURANCE COMPANY FOR MOTOR VEHICLE INSURANCE FOR MADISON VILLAGE AND DECLARING AN EMERGENCY. Mr. Loparo motioned for suspension of the three reading rule. Mr. Toward seconded. All present were in favor. Mr. Burgard motioned for passage of Ordinance #9-2002. Mr. Loparo seconded. All present were in favor.
ORDINANCE #10-2002 was read by Administrator Sample for the first time. AN ORDINANCE ACCEPTING THE BID OF AND AUTHORIZING AND DIRECTING THE VILLAGE ADMINISTRATOR AND CLERK-TREASURER TO ENTER INTO A CONTRACT WITH CLASSIC AUTO GROUP FOR THE PURCHASE OF A 2002 FORD EXPLORER 4x4 XLS FOR USE BY THE MADISON VILLAGE POLICE DEPARTMENT. The net price will be $19,891.35. Mr. Burgard motioned for suspension of the three reading rule. Mr. Smith seconded. All present were in favor. Mr. Britton motioned for passage of Ordinance #10-2002. RESOLUTION #8-2002 was read by Administrator Sample for the first time. A RESOLUTION PROCLAIMING APRIL 27, 2002 AS AUTISM AWARENESS DAY, THROUGHOUT MADISON VILLAGE. Mr. Smith motioned for passage. Mr. Toward seconded. All present were in favor.
RESOLUTIONS #9, 10, 11, 12, 13, & 14-2002 was read by Administrator Sample for the first time. RESOLUTIONS IN HONOR OF MADISON VILLAGE POLICE DEPARTMENT, MADISON TOWNSHIP POLICE DEPARTMENT, MADISON FIRE DISTRICT, PERRY TOWNSHIP FIRE DEPARTMENT, NORTH PERRY VILLAGE POLICE DEPARTMENT AND PERRY VILLAGE POLICE DEPARTMENT. Mr. Smith motioned for passage. Mr. Loparo seconded. All present were in favor.
Mr. Britton announced the Recreation Board would meet on March 28, 2002.
Mr. Loparo would like to attend the Steven LaTourette Legislative Conference set for May 16 and 17, 2002 in Washington D.C. He requested that Council reimburse him for any expenses for this trip.
He also noted that Madison Village is listed with a nice looking ad in the Business Journal and asked Council to consider advertising again.
Mr. Buck received calls on Thursday March 7, 2002 from concerned citizens about people trespassing on their property.

Chief Matty reported that the Carnegie Hero Fund Commission has recognized Geneva resident Oliver J. Wood for rescuing a man from a runaway truck in Madison Village. Mr. Wood has been awarded the CARNEGIE MEDAL.

Mayor Evangelista reported that there is an interest in continuing the Thursday night Concerts in the Park. More information will be available at next Monday’s Council meeting.
He also reported that Helen Britton was chosen as the Senior Center Program Aid. Congratulations to Helen.
