Minutes of Madison Village Meeting held March 4, 2002
REGULAR MEETING March 4, 2002
Mayor Evangelista called the meeting to order at 7:05 pm and invited all in attendance to join in the Pledge of Allegiance.
Council Members Mr. Burgard, Mr. Buck, Mr. Smith and Mr. Toward were present. Mr. Britton and Mr. Loparo were absent. Also in attendance were Clerk-Treasurer Reed, Administrator Sample, Solicitor Murray, Engineer Foley, and Chief Matty.
Mr. Smith motioned to approve the minutes of February 18, 2002. Mr. Toward seconded. All present were in favor. Mr. Buck noted that a sentence on Page 3 should read as follows: Mr. Buck felt that it should be a Village study only.
Clerk-Treasurer Reed presented Pay Order No. 2019 totaling $82,562.35. Mr. Burgard motioned for approval. Mr. Smith seconded. All present were in favor. Also presented was Partial Pay Order No. 2020 for a total of $10,681.35. Mr. Toward made a motion to approve the expenditures listed on Pay Order No. 2020. Mr. Smith seconded. All present were in favor.
Mr. Burgard motioned for a Special Meeting to be held on Monday, March 11, 2002 at 6:30 pm for the main purpose of the budget. Mr. Buck seconded. All present were in favor.
VISITORS
Mr. Jack Lading of 603 West Main Street commended the Village Road Crew for their snow removal efforts this morning. He also questioned when the traffic light would be activated. Administrator Sample stated that they thought it would be activated last week, but are awaiting an electrical inspection and then the Contractor will meet with First Energy to activate the system.
Mr. Chuck Paine of J.C. Nifty Fifty Diner also commended the Village Road Crew for their snow removal efforts. He also requested approval to hold a Car Show every Tuesday evening beginning in June and ending about Labor Day. He anticipates approximately 50 to 100 cars at the show. Mayor Evangelista asked Mr. Paine to approach the surrounding churches and businesses to inquire if this would interfere with their operations and return to Council with a signed and dated letter stating it would not conflict.
Mayor Evangelista welcomed students Kayle Burnheimer and Aaron Rogers to tonight’s meeting.
OLD BUSINESS
ORDINANCE #5-2002 was read by Administrator Sample for the second time. AN ORDINANCE MAKING APPROPRIATIONS FOR CURRENT EXPENSES AND OTHER EXPENDITURES OF THE VILLAGE OF MADISON, STATE OF OHIO, DURING THE FISCAL YEAR ENDING DECEMBER 31, 2002.
ORDINANCE #6-2002 was read by Administrator Sample for the second time. AN ORDINANCE AMENDING ORDINANCE NO. 48-1994, SECTIONS 7,8,24, AND 27, AS TO MODIFY THE RATES TO BE CHARGED FOR WATER AND WATER SERVICES AND DECLARING AN EMERGENCY.
NEW BUSINESS
ORDINANCE #7-2002 was read by Administrator Sample for the first time. AN ORDINANCE AMENDING ORDINANCE NO. 49-1994, SECTIONS 4B, 11, AND 12 AS TO MODIFY THE RATES TO BE CHARGED FOR SANITARY SEWERAGE SERVICE AND DECLARING AN EMERGENCY.
ORDINANCE #8-2002 was read by Administrator Sample for the first time. AN ORDINANCE AUTHORIZING AND DIRECTING THE VILLAGE ADMINISTRATOR AND CLERK-TREASURER TO ENTER INTO A CONTRACT WITH GEHRING’S AGENCY, INC. ON BEHALF OF GENERAL STAR NATIONAL INDEMNITY COMPANY FOR LAW ENFORCEMENT LIABILITY INSURANCE FOR MADISON VILLAGE AND DECLARING AN EMERGENCY.
ORDINANCE #9-2002 was read by Administrator Sample for the first time. AN ORDINANCE AUTHORIZING AND DIRECTING THE VILLAGE ADMINISTRATOR AND CLERK-TREASURER TO ENTER INTO A CONTRACT WITH GEHRING’S AGENCY, INC. OF BEHALF OF WESTFIELD INSURANCE COMPANY FOR MOTOR VEHICLE INSURANCE FOR MADISON VILLAGE AND DECLARING AN EMERGENCY.
DISCUSSION
ROUTE 2 STUDY
After a brief discussion of the Route 2 study proposal, a motion was made by Mr. Smith to table the discussion. Mr. Toward seconded. All present were in favor.
RAILROAD OVERPASS/ UNDERPASS
Mr. Buck reported that on February 27, 2002, he sent a letter to the Ohio Department of Transportation to the attention of Mr. Dale Schiavoni, exploring the possibility of a full study for the purpose of a railroad underpass in the Village. In his letter he noted that the Police Department had issued 11 citations for trains stopped and blocking the crossings between 12/01/01 and 2/22/02. Mr. Buck spoke with Mr. Schiavoni today on the telephone and it was indicated to Mr. Buck that generally these studies are not free, that there could be a 5% cost to the applicant. If the study’s cost was $70,000 it could cost the Village $3,500.
COUNCIL REPORTS
Mr. Toward inquired about Brian Dorr and a Dixieland band as entertainment in the Park.
Mr. Smith stated that there would be a workshop for the Fire Board on Wednesday, March 6, 2002 at Village Hall. He noted the Road Department did a fantastic job with snow removal.
Mr. Buck reported that he attended the Madison Area Development Corporation meeting on February 21, 2002. The next M.A.D.C. meeting will be March 21, 2002 at 6:30 pm at the Madison Public Library. He also reported that the Planning Commission met on February 25, 2002 at 7:00 pm. Public Hearing will be held on March 18, 2002 at 6:30 pm at Village Hall in regards to the zoning change requested by Betteley Construction. The next Planning Commission Meeting will be on March 11, 2002 at 7:00 pm at Village Hall.
Mr. Buck also reported that while he was in Pennsylvania recently, he spoke with a restaurant and Inn owner about the possibility of opening 3 more locations, and the owner expressed an interest in the Route 90 interchange.
Mr. Burgard reported that he had the opportunity to attend the Ribbon Cutting Ceremony for the Willowick Senior Center. He expressed an interest in obtaining nametags for Council Members to possibly wear to such outings.
ENGINEER’S REPORT
None
SAFETY DEPARTMENT REPORT
Chief Matty reported that 2 Officers were eligible to be removed from Probation in February. This includes full time Officer Ian Mussell and part time Officer James Middleton. It is his recommendation as Chief that their appointment be finalized. Mayor Evangelista recommended that this be done at the Special Meeting planned for Monday March 11, 2002.
He also inquired as to when it would be possible to hold recognition for the Knights of Columbus Officers of the Year, Jason Clark and Chris Matty. Mayor Evangelista recommended March 18, 2002.
Chief Matty reported that he is involved with Phase 2 of the Digital Communication Committee. After a brief discussion of the problems with the reception, Chief Matty stated he would keep Council informed of any changes.
Administrator Sample reported that 15 bronze markers for the headstones that are not legible in the cemetery have been ordered. This is being done in hopes that they will be legible for years to come.
Administrator Sample has photos available for Council to view for the website. He would also like everyone’s biography to include on the well used website.
Administrator Sample reported that he ordered a bronze plaque for the dedication of the Senior Center.
He also reported that there are 4 issues for Public Hearings on March 18, 2002 at 6:30 pm. April 15, 2002 at 6:30 pm will also be another Public Hearing.
Administrator Sample noted that a change is needed to the diagonal parking spaces by the new traffic signal.
Mayor Evangelista reported that there is still an opening on the Board of Zoning Appeals. He will accept resumes for that position until March 11, 2002.
Mayor Evangelista advised Council that even though the Village received a rate increase from the Lake County Water Department. Lake County Water Department may consider other adjustments in the future.
Mayor Evangelista noted that the Community Improvement Corporation (C.I.C.) held their meeting and appointed a new Chairman of the Executive Committee.
He also noted that he received a letter from Madison, Connecticut asking us to help honor President Madison as one of the greatest founding fathers of our country.
He also received a letter from Harvest for Hunger asking for Village Hall to be a collection point for food. It was noted that the Senior Center is also a food collection point.
Mayor Evangelista received a letter from Lake County Solid Waste District regarding curbside recycling asking if our community would like to be included in the bid for curbside recycling at no cost to the Village. Administrator Sample recommended the Village be part of that study. This will enable the Village to decide whether it will participate in the recycling contract for 2003.
Mr. Burgard motioned to reserve Madison Village Park for May 27, 2002 for Memorial Day activities of American Legion Post 112. Mr. Smith seconded. All present were in favor.
Mayor Evangelista listed the following dates to remember: March 11, 2002 will be the Planning Commission Meeting. March 14, 2002 is the Madison/Perry Area Chamber of Commerce Community Service Awards at the Madison Country Club. March 14, 2002 will be Mayors Court. March 18, 2002 will be the next Regular Council Meeting.
Administrator Sample noted that Madison Village issued 6 zoning permits for construction of new homes in the month of February.
He stated that there would be 6 new streetlights on the corner of West Main and River Street. Also on order are 16 new streetlights for Village Square to replace the old lights.
Mr. Toward motioned to adjourn the meeting at 8:00 pm. Mr. Burgard seconded. All present were in favor.
