Regular Meeting

May 1, 2006

 

Record of Proceedings

 

Mayor Evangelista called the meeting to order at 7:00 p.m. and invited all in attendance to join in the Pledge of Allegiance to the American Flag.  Mayor Evangelista requested that everyone observe a moment of silence.  Council Members Mr. Britton, Mr. Hamercheck, Mr. Lee, Mr. Loparo and Mr. Vest were present. Also in attendance, Mayor Evangelista, Administrator Zapp, Solicitor Murray, Eric Haibach for Engineer Foley and Fiscal Officer Pinkert.  Mr. Britton informed everyone that Mr. Buck wouldn’t be at the meeting because he had to work.

 

Motion by Mr. Lee, seconded by Mr. Vest, to approve the minutes of the regular meeting of April 17, 2006, as presented.  Roll call on the motion, 5 yeas. Motion passed.

 

Fiscal Officer Pinkert presented Pay Ordinance No. 2111 totaling $34,655.23 for payroll and $38,709.13 for current and upcoming expenses.  Motion by Mr. Loparo, seconded by Mr. Britton, to approve Pay Ordinance No. 2111.  Roll call on the motion, 5 yeas.  Motion passed.

 

 

VISITORS

 

Rich Janco, 178 E Main Street, asked for clarification on Ordinance No. 26-2006. Fiscal Officer Pinkert explained that ordinance No. 26-2006 is to roll over an existing note and that the Village is paying $30,000 on the principle. Mr. Janco also asked if the garbage contract with World Resource Recovery was terminated due to poor service, why the Village is considering approving a settlement with them.  Mayor Evangelista said that Ordinance No. 28-2006 is approving a settlement for what the Village owes World Resource Recovery for previous invoices.  Solicitor Murray explained that the Village had 2.5 months of outstanding bills and that World Resource agreed to payment for 9 toters instead of the 27 originally requested.  He added that World Resource Recovery also agreed to pay the court costs. 

Mr. Janco also thanked the Village for picking up his 33 bags of leaves. 

 

Ms. Madison Taxpayer, address unknown, said that she has been resident for ten years and that she objects to the cuts in services and asked what her taxes are paying for.  Mayor Evangelista said that the Village is operating on income taxes and that there is nothing available for extras.  Administrator Zapp said that many of the services being cut originated from grants and that Village continued them after the funding was gone.  Mayor Evangelista invited her to meet with Administrator Zapp to go over the figures. 

 

 

OLD BUSINESS

 

ORDINANCE NO. 16-2006 was read by Solicitor Murray, third reading.  AN ORDINANCE CONFIRMING THE FINAL APPOINTMENT OF MARK FORSYTHE AS CHIEF OF POLICE FOR THE MADISON VILLAGE POLICE DEPARTMENT.

 

 

Motion by Mr. Britton, seconded by Mr. Loparo to approve Ordinance No. 16-2006.  Roll call; 3 yeas, 1 nay (Vest) and 1 abstain (Hamercheck).  Mayor Evangelista requested a ruling from Solicitor Murray.  Solicitor Murray explained that the abstention would go to the majority making it yes vote and the ordinance passes.  Ordinance No. 16-2006 duly passed. 

 

ORDINANCE NO 21-2006 was read by Solicitor Murray, second reading.  AN ORDINANCE AMENDING SECTION 25 OF ORDINANCE NO. 10-2004 TO MODIFY THE TAP-IN FEE FOR SANITARY SEWER SERVICE FOR RESIDENTS OF THE VILLAGE OF MADISON.

 

 

NEW BUSINESS

 

ORDINANCE NO.26-2006 was read by Solicitor Murray, first reading.  AN ORDINANCE PROVIDING FOR THE ISSUANCE AND SALE OF $70,000 NOTES, IN ANTICIPATION OF THE ISSUANCE OF BONDS, for the purpose of paying a portion of the cost of acquiring certain real estate AS THE SITE OF, constructing, furnishing, equipping, improving the site of, and otherwise improving, a municipal complex to house municipal offices and functions, AND DECLARING AN EMERGENCY.

Motion by Mr. Loparo, seconded by Mr. Lee, to suspend the three reading rule for Ordinance No. 26-2006.  Roll call, 5 yeas.  Motion passed.  Motion by Mr. Loparo, seconded by Mr. Vest, to approve Ordinance No. 26-2006.  Roll call, 5 yeas.  Ordinance No. 26-2006 duly passed.

 

ORDINANCE NO.27-2006 was read by Solicitor Murray, first reading.  AN ORDINANCE ADOPTING THE CHANGES TO THE MADISON SENIOR CENTER BYLAWS AS RECOMMENDED BY THE MADISON SENIOR CENTER BOARD.

Motion by Mr. Loparo, seconded by Mr. Vest, to suspend the three reading rule for Ordinance No. 27-2006.  Roll call, 5 yeas.  Motion passed.  Motion by Mr. Loparo, seconded by Mr. Lee, to approve Ordinance No. 27-2006.  Roll call, 5 yeas.  Ordinance No. 27-2006 duly passed.

 

ORDINANCE NO.28-2006 was read by Solicitor Murray, first reading.  AN ORDINANCE AUTORIZING THE MAYOR AND FISCAL OFFICER TO ENTER INTO A SETTLEMENT AGREEMENT AND RELEASE WITH WORLD RESOURCE RECOVERY SYSTEMS OF OHIO, INC. TO RESOLVE PENDING LITIGATION REGARDING THE RESIDENTIAL REFUSE AND GARABAGE COLLECTION AND DISPOSAL SERVICES FOR VILLAGE RESIDENTS, AND DECLARING AN EMERGENCY.

Motion by Mr. Vest, seconded by Mr. Loparo, to suspend the three reading rule for Ordinance No. 28-2006.  Roll call, 5 yeas.  Motion passed.  Motion by Mr. Britton, seconded by Mr. Lee, to approve Ordinance No. 28-2006.  Roll call, 5 yeas.  Ordinance No. 28-2006 duly passed.

 

Mayor Evangelista recognized Madison Township Trustee Wayman in attendance. 

 

 

QUESTION & ANSWERS

 

Larry Larson, 239 W Main Street, said that the hiring of Mark Forsythe saddens him and that it will be a downfall for Madison Village.  He also apologized to the village residents for not doing a better job. 

 

Ms. Madison Taxpayer, address unknown, suggested that everyone rent the movie “Dave” in order to learn about a government for the people. 

 

 

COUNCIL REPORTS

 

Mr. Britton inquired about the updated auxiliary police procedures.  Solicitor Murray said that they will available for review at the next meeting.

 

Mr. Hamercheck said that the Recreation Board has requested the Village please fill the vacancy on the board.  Mayor Evangelista said that both Carl Smoot and Rick Burnhiemer have expressed interest in the position. 

Mr. Hamercheck inquired mentioned the information from the Lake County Planning Commission regarding a comprehensive plan and asked that it be reviewed and considered by the Village.  Mayor Evangelista said that it has to be put on the Madison Village Planning Commission agenda and that they can make a recommendation to Council.  He added that the expense isn’t realized until the end of the project. 

 

Mr. Hamercheck also requested an aggressive approach to creating a master plan for the Village.

 

Mr. Vest reported the following:

  1. The Planning Commission is making progress revising the Zoning Code. 
  2. There is a public hearing on May 8, 2006, at 7:00 for John Fry’s request for a change from R2 to B1.

Mr. Vest also said that there are more kids outside because the weather is getting nice and requested everyone be careful.

Administrator Zapp reminded everyone that there is also a hearing on May 8th for Wayman Farms for a request to sell agricultural products in an M1 district.

 

Motion by Mr. Britton, seconded by Mr. Hamercheck, to appoint Carl Smoot to the Recreation Board to fill a three-year term beginning January 1, 2006.  Roll call on the motion, 5 yeas.  Motion passed.

 

Mr. Loparo thanked John Hamercheck for bringing the Lake County Comprehensive Plan information forward.  He also said that there is a Fire Board meeting on May 3, 2006, at village hall and encouraged everyone to vote on May 2, 2006. 

 

Mr. Lee encouraged everyone to vote and support the Fire Board issue.

 

 

ENGINEER’S REPORT

 

Eric Haibach said that the new cul de sac in Huntington Woods Phase III has to have some major repairs due to a sub base failure.

 

FISCAL OFFICER REPORT

 

No report.

 

 

ADMINISTRATOR’S REPORT

 

Administrator Zapp encouraged anyone with questions to contact him.  He also reported the following:

1.      Leaf program is going well.

2.      Thanks to the Garden Club, local businesses, and everyone else that supported the downtown beautification.

3.      The cemetery crew has started.

4.      There will be an update on the WWTP expansion by CT Consultants on May 15, 2006 at 6:00pm.

5.      There is a public hearing regarding changes to swimming pool regulations on May 15, 2006 at 6:30pm.

 

 

MAYOR’S REPORT

 

Mayor Evangelista reported the following:

 

1.      The Perry Amnesty International Chapter hasn’t gotten back to the Village with information requested for the use of the Village Park.

2.      The Shawnee Dancers requested confirmation of the use of the Village Park Bandstand on Wednesdays.

3.      The TEL Amendment proposed by Ken Blackwell could be the most damaging legislation proposed in many years.  Please review the information and consider a resolution opposing it. 

4.      Officially the talks have resumed with Madison Township regarding a Joint Economic Development District (JEDD).

5.      The Mayor’s Conference is in Washington DC June 14-16, 2006.  The only cost to the Village is the lodging.

 

There was some discussion about a JEDD.  Mr. Britton said that Wal-Mart isn’t in the JEDD right now.  Mr. Hamercheck requested an effort to have more honest wording in any agreement for a JEDD.  Mr. Lee suggested a joint public meeting with Madison Township to get information and discuss a JEDD.  Mr. Loparo said the issue will probably have to go before the citizen’s for a vote. 

 

The Motion by Mr. Vest, seconded by Mr. Britton, to approve the use of the Village Park Bandstand by the Shawnee Dancers.  Roll call on the motion, 5 yeas.  Motion passed.
