RECORD OF PROCEEDINGS
Mayor Evangelista called the meeting to order at 7:03 pm and invited all in attendance to join in the Pledge of Allegiance.
Council Members Mr. Britton, Mr. Buck, Mr. Burgard, Mr. Loparo, Mr. Smith, and Mr. Toward were present. Also in attendance were Administrator Sample, Clerk-Treasurer Reed, Solicitor Murray, Chief Matty, and Engineer Foley.
Mr. Burgard motioned to approve the minutes of the May 5, 2003 meeting. Mr. Buck seconded. All present were in favor except Mr. Smith who abstained.
Clerk-Treasurer Reed presented Pay Ordinance #2045 totaling $78,064.84. Mr. Smith motioned to approve Pay Ordinance #2045. Mr. Burgard seconded. All present were in favor.
Mr. Chuck Dome of 190 Manchester Court has concerns of the standing water in his back yard. He is hoping that Council might be able to convince the developer to put better drainage in the back of the development. Engineer Foley assured him that there is a plan that will be followed that should eliminate the problem.
Mr. Wayne Clough of 194 Manchester Court echoed Mr. Dome. He also has standing water in his yard. In order to cut his grass, he has to first pump water out of the ditch for 8-12 hours. The topsoil and seed have been washed away. Engineer Foley asked both men for patience in resolving this problem.
Mr. Bill Skidmore of Waste Management in Chardon, Ohio has two issues to discuss. The first is to make sure that Council received the letter he sent last week and that they had the opportunity to read it. He was assured that is was received. The second issue is to share the success story of this past Saturday in the junk pick up. They had 6 collection vehicles out, with just over 60 man-hours. He stated that he appreciates the work.

ORDINANCE #19-2003 was read by Administrator Sample for the third time. AN ORDINANCE AWARDING A BID TO, AND AUTHORIZING EXECUTION OF A CONTRACT WITH WORLD RESOURCE RECOVERY SYSTEMS OF OHIO INC. FOR THE COLLECTION, HAULING AND DISPOSAL OF RESIDENTIAL GARBAGE AND REFUSE IN MADISON VILLAGE. Mr. Britton motioned for passage of Ordinance #19-2003. Mr. Burgard seconded. Mr. Britton stated that although he knows Waste Management did a fine job over the last several years, he feels Council owes the residents a savings of $15,000 over three years. Mr. Toward understands the financial concerns however he feels that the cheapest isn’t necessarily the best, but he likes the “known entity”. Mr. Buck agreed with Mr. Toward. The vote was tied with 3 ‘no’ votes and 3 ‘yes’ votes. Mayor Evangelista broke the tie with a yes. Ordinance #19-2003 passed.
ORDINANCE #22-2003 was read by Administrator Sample for the third time. AN ORDINANCE APPROVING THE FINAL PLAT AND THE FINAL SUBDIVISION IMPROVEMENT PLANS OF PHASE II OF HUNTINGTON WOODS SUBDIVISION. Mr. Toward motioned to table Ordinance #22-2003. Mr. Britton seconded. All present were in favor.
ORDINANCE #24-2003 was read by Administrator Sample for the first time. AN ORDINANCE PROVIDING FOR ADDITIONAL APPROPRIATIONS AND ADJUSTMENTS TO VARIOUS LINE ITEMS FOR THE CURRENT EXPENSES AND FOR OTHER EXPENDITURES OF THE VILLAGE OF MADISON, OHIO, FOR THE PERIOD BEGINNING JANUARY 1, 2003, TO AND INCLUDING DECEMBER 31, 2003, AND DECLARING AN EMERGENCY. Mr. Smith motioned for suspension of the three reading rule. Mr. Britton seconded. All present were in favor. Mr. Smith motioned for passage of Ordinance #24-2003. Mr. Toward seconded. All present were in favor.
ORDINANCE #25-2003 was read by Administrator Sample for the first time. AN ORDINANCE INCREASING THE COMPENSATION OF THE MAYOR ELECTED OR APPOINTED TO A TERM OF OFFICE COMMENCING ON OR AFTER JANUARY 1, 2004 AND DECLARING AN EMERGENCY.
ORDINANCE #26-2003 was read by Administrator Sample for the first time. AN ORDINANCE INCREASING THE COMPENSATION FOR MEMBERS OF COUNCIL ELECTED OR APPOINTED TO A TERM OF OFFICE COMMENCING ON OR AFTER JANUARY 1, 2004 AND DECLARING AN EMERGENCY.
ORDINANCE #27-2003 was read by Administrator Sample for the first time. AN ORDINANCE INCREASING THE COMPENSATION OF THE CLERK-TREASURER ELECTED OR APPOINTED TO A TERM OF OFFICE COMMENCING ON OR AFTER JANUARY 1, 2004 AND DECLARING AN EMERGENCY.
RESOLUTION #13-2003 was read by Administrator Sample. A RESOLUTION DECLARING THE NECESSITY TO IMPROVE CERTAIN STREETS IN THE VILLAGE OF MADISON BY SUPPLYING SAME WITH ELECTRIC STREET LIGHTING, AND DECLARING AN EMERGENCY. Mr. Smith motioned for passage of Resolution #13-2003. Mr. Burgard seconded. All present were in favor.
ORDINANCE #28-2003 was read by Administrator Sample for the first time. AN ORDINANCE AUTHORIZING AND DIRECTING THE TAX COMMISSIONER TO ADOPT THE NEW RULES AND REGULATIONS OF THE CENTRAL COLLECTION AGENCY. Mr. Smith motioned to suspend the three reading rule. Mr. Britton seconded. All present were in favor. Mr. Britton motioned for passage of Ordinance #28-2003. Mr. Smith seconded. All present were in favor.
Mr. Britton reported that they found a 1958 Ford Edsel for Madison Old Fashioned Days.

Engineer Foley reported that obviously they are working in Huntington Woods.
Chief Matty reported that on Wednesday May 21, 2003, they would be conducting a Buckle Down program along with the Township at Madison High School at 7:00 am. On May 28, 2003 in conjunction with Norfolk & Southern they will be conducting a crossing blitz at North Lake Street in the morning hours. Chief Matty wanted to remind everyone that on Monday, May 26, 2003 at 11:00 am, the Memorial Day Parade would be held. Chief Matty reported that in talking to the Mayor, he is in receipt of a contract with Lake County Central Communications for dispatching. It is the usual 5% per year. Because of the summer hours, it was advised to bring it before Council tonight. Ordinance #29-2003 is an ordinance to renew on a three-year term, the Central Communications Contract.
Administrator Sample reported that the crews are actively getting the town ready for Memorial Day. The Garden Club will be here on Wednesday, planting flowers in the park and around trees and lampposts and they will be putting up 50 hanging baskets.
Administrator Sample is seeking approval to spend $2,703 for the EPA to issue a permit to install the sanitary sewer line for the Parkway lift station elimination. Mr. Britton motioned for approval. Mr. Buck seconded. All present were in favor.
Administrator Sample explained a possible solution for the drainage problems like the ones they are having in Huntington Woods. Instead of each developer hiring a surveyor/engineer to do the ‘as built’, CT Consultants would be paid upfront to check the elevations as they go along to alleviate any problems. He will have legislation ready at the next council meeting to hopefully avoid some of the problems there have been in the past.
Administrator Sample also noted that he would be sending notices to residents who have not yet mowed their grass. They will be given 7-10 days to do so, or it will be mowed for them at the homeowners expense added onto their taxes.
Mayor Evangelista stated that the Senior Board met this past week and he copied Council of the 3 three topics of discussion. He would like to thank Administrator Sample and Clerk-Treasurer Reed for helping with the Community Development Block Grant. Another topic of discussion is the electricity at the pavilion. Administrator Sample will gather costs to run electricity with outlets and a peanut light on the flagpole and present it at the next meeting. Another request is from the Senior Center to put a flashing light at the driveway for the Center. Mayor Evangelista also noted that Rae Jean Burgard has renewed her certification as Senior Center Manager.
The Community Reinvestment Area will be put back into place. This abates only new construction gain and value. This is an incentive to help revitalize the downtown area.
Council received a copy of the income tax revenues. It shows that the income tax revenue is down from last year almost $17,000.
Madison Police Department sent a thank you to two of the Village Officers, Mark Forsyth and Ian Mussell. A robbery occurred at Chapeldale Cleaners. Those two officers spotted and stopped the robbers on Route 84 and they notified Chief Jenkins. Also, on May 2, 2003 Patrolman Svagerko and Patrolman Forsyth located and assisted with a shoplifter coming from Tops Supermarket, attempting to shoplift large amounts of cold medications commonly used in production of methamphetamines.
Mayor Evangelista has been trying to contact Trustee Paul Brunner to set up a meeting concerning Inside Millage. He is waiting for Trustee Brunner to return his call. He feels this could be resolved.
The Design Review Board is adding a clause to include advisors. Advisors would be non-voters in the process.
Some upcoming dates include: May 26, 2003 is the Memorial Day Parade with Judge Martin Parks as the guest speaker, June 9, 2003 is the next Council Meeting, June 5, 2003 is Mayors’ Court, June 14, 2003 is Flag Day, and June 19, 2003 is Mayors’ Court.
Mr. Britton motioned to adjourn to Executive Session at 9:05 pm for the purpose of Personnel and Legal. No further business will be held. Mr. Smith seconded. All present were in favor.
