Regular Meeting

November 15, 2004

 

 

Record of Proceedings

 

Mayor Evangelista called the meeting to order at 7:03 p.m. and invited all in attendance to join in the Pledge of Allegiance to the American Flag.

 

Council members Mr. Britton, Mr. Buck, Mr. Burgard, Mr. Loparo, Mr. Toward and Mr. Vest were present. Also in attendance; Mayor Evangelista, Administrator Sample, Solicitor Murray, Fiscal Officer Pinkert and Engineer Foley.

 

Motion by Mr. Vest, seconded by Mr. Burgard, to approve the minutes of the regular meeting on November 1, 2004, as presented.  Roll call on the motion, 5 yeas and 1 abstain (Mr. Toward).  Motion passed.

 

Fiscal Officer Pinkert presented Pay Ordinance #2077 totaling $78,301.56 for current and upcoming expenses.  Motion by Mr. Britton, seconded by Mr. Buck, to approve Pay Ordinance #2077.  Roll call on the motion, 6 yeas.  Motion passed.

 

 

VISITORS

 

Mayor Evangelista welcomed local Boy Scouts that attended the meeting as part of a badge requirement.

 

John Hammercheck, representing Lake Shore Masonic Lodge #307 invited Madison Village Council and Officials to their annual Christmas party on December 17th

 

Ron Smith, 379 Kim Drive, expressed concerns about the police training for M16 weapons and the increased liability if the weapons are carried in the cruisers.  Mayor Evangelista said that the Police Department is just training and that no decision has been made allowing the weapons to be carried in the cruisers.

 

Larry Larson, 239 W Main Street, stated that he was acting on behalf of the community and asked the following questions:

1. Why do the Police need M16s?

            Mayor Evangelista said that the Homeland Security Act made the weapons available after 911 and that it allows the Police Department to be better prepared.

2. Who is qualified and by whom?

            Acting Chief Forsythe said that 5 officers have been trained and that of Madison Township provided the training.  He added that the weapons won’t be fully automatic if they are put in the cruisers.

3. When is the search for a new Police Chief going to start?

            Mayor Evangelista answered that the Safety Committee will meet to discuss the performance of the Acting Chief and a possible new search after January 1, 2005. 

4. Where does the school zone start and end on Main Street?

Mayor Evangelista said that it is currently not marked.  Solicitor Murray said that the traffic study was sent to the Ohio Department of Transportation and that the Village is waiting for a response from them. 

5. Is the lawsuit against the Village resolved and what has been expended to date for that lawsuit?

 

 

Mayor Evangelista said that the suit has been moved to federal court and the attorneys are handling the issue.  Fiscal Officer Pinkert said that she will get a listing of the legal expenses for the lawsuit to Mr. Larson after the meeting.

 

Beth Miller, USO Project Coordinator, informed everyone that there will be drop off site on Middle Ridge Rd. for donations.

ADMINISTRATOR’S REPORT

 

Administrator Sample reported the following:

Although a bearing had to be replaced on the leaf machine, leaf pick-up continues and the majority of the volume should be done by the end of the week.

 

 

 

The Village will be continuing to cite for junk cars and unlicensed vehicles.

 

Income Tax collections are up for November 2005 compared to November 2004, due mainly to collection of delinquent income taxes.

 

The son of Mayor’s Court Clerk Cathy Katona has returned from his second tour of duty in Iraq.

 

 

MAYOR’S REPORT

 

Mayor Evangelista reported the following:

He received a thankful phone call from a citizen informing him that Officer Verdi helped her daughters after they were stranded on I-90 and safety forces from other organizations failed to stop and help them.

 

The Village is working on the budget for 2005; revenues are down for 2004 from expectations.  He added that the budget 2005 should be approved as soon as possible and suggested Council review the current status of income and expense projections.

 

Delinquent income taxes in the amount of $24,000 have been collected this year which the Village needs to meet the community needs for the balance of 2004.

 

The Lake Shore Masonic Lodge #307 has received recognition for community participation at Madison Old fashioned Days with their child identification program.  He added that 406 children took advantage of the program and requested Village Council recognize the organization with a resolution.

 

Motion by Mr. Toward, seconded by Mr. Britton, approving Resolution No. 22-2004 honoring Lake Shore Masonic Lodge #307 for its outstanding community participation.  Roll call on the motion, 6 yeas.  Resolution No. 22-2004 duly adopted

Motion by Mr. Toward, seconded by Mr. Buck, to adjourn.  Roll call, 6 yeas.  Meeting Adjourned at 7:34 pm.
