Record of Proceedings

 

Mayor Evangelista called the meeting to order at 7:00 p.m. and invited all in attendance to join in the Pledge of Allegiance to the Great Flag of our country. Mayor Evangelista requested that everyone observe a moment of silence.  Council Members Mr. Britton, Mr. Bartlett, Mr. Hamercheck, Mr. Lee, Mr. Loparo and Mr. Vest were in attendance.  Also in attendance Mayor Mike Evangelista, Solicitor Mike Murray, Administrator Matt Zapp, Temporary Fiscal Officer Tony Long and Ned Foley.  Police Chief Mark Forsythe was excused.

 

Mayor Evangelista announced there are is one set of minutes to be approved.

November 5th, 2007 Move to passage by Mr. Vest, seconded by Mr. Britton.  Roll call on motion, 5 yeas, 1 abstain, Mr. Loparo.

 

Mayor Mike Evangelista presented Pay Ordinance No. 2148 totaling $26,263.91 for payroll and $71,710.62 for current and upcoming expenses.    Motion by Mr. Britton, seconded by Mr. Hamercheck to approve Pay Ordinance No. 2148.  Roll call on the motion, 6 yeas.  Motion carried.

 

Comments on Legislation

 

Richard Janco, 178 E. Main Street, Ordinance 62-2007, questioned where would the money come from for this ordinance.  Solicitor Murray said that she will be paid her accrued vacation and sick time that she has accrued through December 31, 2007.  She will be paid throughout next year.  Acting Fiscal Officer, Tony Long said that the remainder will have to be supplemented out of the general fund. 

 

Gordon Musclow, 178 Willowbend, Ordinance 59-2007, he understands.  Ordinance 58-2007, What is Lewis Wastewater Management Inc. going to be doing for us for $2,000.00 a month?

Mr. Zapp said that our requirements per EPA in order to be in compliance we need someone here 20 hours a week with a Class III Waste Water Certification.

 

Larry Larson, 239 W. Main Street, Ordinance 60-2007, are we hiring Tony Long as a part-time fiscal officer?  Yes.  Ordinance 61-2007, what is the extended duties these employees are taking on. Mr. Zapp explained the duties the employees have been doing since the beginning of November.  Asked if Cathy Katona was qualified for the extra duties and Mr. Zapp explained she has been doing an excellent job but she would not be responsible for Budgets or CCA collections.

 

Paul Goda, 431 W. Main Street, Ordinance 47-2007, can the records custodian be a civilian.  House Bill 9 gives us the requirements.  The person needs to be an employee of the Village.  Records request is paid for materials not the person’s actual time.  Ordinance 48-2007, is there a fee to collect our assessments?  Mayor Evangelista stated that the Auditor charges 3% to collect.

Ordinance 58-2007, questioned if someone from the village could take on the position.  Mr. Zapp stated what it takes to become a Class III Certification. Failure to comply with EPA on minimum requirements could be a fine of $10, 0000 a day.

 

Old Business

 

ORDINANCE 47-2007 was read by Solicitor Murray.  AN ORDINANCE ESTABLISHING THE PUBLIC RECORDS POLICY AND DESIGNATING A RECORDS CUSTODIAN FOR THE VILLAGE OF MADISON AND DECLARING AN EMERGENCY. (Second  reading)

ORDINANCE 48-2007 was read by Solicitor Murray.  AN ORDINANCE CERTIFYING DELINQUENT SANITARY SEWER CHARGES, WATER RENTS, AND REFUSE AND GARBAGE COLLECTION FEES TO THE LAKE COUNTY AUDITOR FOR COLLECTION AS OTHER MUNICIPAL TAXES ARE COLLECTED, AND DECLARING AN EMERGENCY. (Second reading)

ORDINANCE 49-2007 was read by Solicitor Murray.  AN ORDINANCE IMPLEMENTING SECTIONS 3735.65 THROUGH 3735.70 OF THE OHIO REVISED CODE, ESTABLISHING AND DESCRIBING THE BOUNDARIES OF COMMUNITY REINVESTMENT AREA #3 IN THE VILLAGE OF MADISON, AND ESTABLISHING A TAX INCENTIVE REVIEW COUNCIL AND DECLARING AN EMERGENCY. (Second reading)

ORDINANCE 53-2007 was read by Solicitor Murray.  AN ORDINANCE AMENDING SECTION 5 (D) OF ORDINANCE 37-1985 OF THE POLICE PERSONNEL HANDBOOK TO INCREASE THE UNIFORM ALLOWANCE FOR FULL-TIME AND PART-TIME POLICE OFFICERS AND DECLARING AN EMERGENCY. (Second reading)

New Business

 

ORDINANCE 57-2007 was read by Solicitor Murray.  AN ORDINANCE CONFIRMING THE APPOINTMENT OF JASON CHAPMAN AS A FULL TIME SEASONAL ROAD CREW WORKER FOR MADISON VILLAGE, ESTABLISHING PAY AND DECLARING AN EMERGENCY.(First Reading)

Move for suspension by Mr. Lee, seconded by Mr. Bartlett.  Roll call on suspension, 4 yeas, 2 nos. Motion failed.  Go to second reading.

 

ORDINANCE 58-2007 was read by Solicitor Murray.  AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR AND FISCAL OFFICER TO ENTER INTO A CONTRACT WITH LEWIS WASTEWATER MANAGEMENT INC. TO PROVIDE CLASS III WASTE WATER CERTIFICATION AND DECLAING AN EMERGENCY. (First Reading)

ORDINANCE 60-2007, was read by Solicitor Murray.  AN ORDINANCE APPOINTING TONY LONG TO THE POSITION OF VILLAGE FISCAL OFFICER IN ACCORDANCE WITH THE PROVISIONS OF SECTION 733-262 OF THE OHIO REVISED CODE, ESTABLISHING HIS COMPENSATION AND DELARING AN EMERGENCY.  (First Reading)

ORDINANCE 62-2007 was read by Solicitor Murray.  AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR AND FISCAL OFFICER TO ENTER INTO A SETTLEMENT AGREEMENT WITH RAE JEAN BURGARD, ACCEPTING HER RESIGNATION AND DECLARING AN EMERGENCY. (First reading)

ORDINANCE 63-2007 was read by Solicitor Murray.  AN ORDINANCE PROVIDING FOR ADDITIONAL APPROPRIATIONS AND ADJUSTMENTS TO ARIOUS LINE ITEMS FOR THE CURRENT EXPENSES AND FOR OTHER EXPENDITURES OF THE VAILLAGE OF MADISON, OHIO, FOR THE PERIOD BEGINNING JANUARY 1, 2007, TO AND INCLUDING DECEMBER 31, 2007, AND DECLARING AN EMERGENCY. (First reading)

Hearing of the Public

 

Sheryl Flanigan, 1921 Aberdeen Road, Madison Township, Comment on Rae Jean Burgard’s help during the flood even though her own house was flooded. Also, thanked council for eye contact when she speaks to them.

 

Sheryl Oravitz, 7311 South Ridge Road, Madison Township, She wanted information on when the Senior Center is open on Friday.  Mr. Zapp stated that Friday is a holiday so the center will be closed due to no one to man the center. She asked if anything can be changed regarding the situation.  Mr. Murray said that the settlement was in the best interest of all parties involved. She asked if the senior center was moving or being used for something else.  Mayor Evangelista said that there are no plans of any change it was built as a senior center by United Way funds.  Mr. Zapp is working on having after hour programs for senior center to meet at Stratton Place for the month of December.

 

Deborah Charlton, 1921 Aberdeen Road, Madison Township, Comment on all the things Rae Jean Burgard’s has done for the senior center.  Where is the money coming from to pay for the new director?  She is appalled about how far all this dirty laundry has gone.

 

Mary Lou McCracken, 1674 Trinity Road, Madison Township, Comment on all the things Rae Jean Burgard’s has done for the senior center and the whole Madison community.

 

Janine Hathaway, 215 W. Parkway Drive, Mr. Murray was asked on the investigation of the missing auxillary money.  He is working on checking into the record keeping and he is working on following up on finding the information.

 

Bobbie Wagner, 1869 Benjamin Road, Madison Township, She is positive that Rae Jean cares about the people and they will be sorry that they got rid of a good employee both the township and Village.

 

Richard Janco, 178 E. Main Street, He has only lived here a few years and there has been three buyouts.  If it was so dire why isn’t anyone fired. 

Mr. Murray commented that in this particular case, there were some issues that came up and they decided to enter into an agreement and move on.  Mayor Evangelista said that this is personnel issue and that we cannot discuss this in public comment.

 

Jack Lading, 603 W. Main Street, What is the current status of the alleged Comfort Inn?  Mayor Evangelista said that they lost one of their bank investors and he is looking for new investors.  Where is the repairs done on village equipment?  Mr. Zapp said that most is done in house.  Madison Auto Works, Commercial Truck and Davis does some of the repairs. 

 

Kathy Lynn, 209 W. Main Street, Questioned who is benefiting with Rae Jean leaving?  Mr. Murray answered that the Township will have to ratify the agreement and the senior board will start advertising for the open position.  Mr. Zapp said that Mrs. Britton is working and Maggie from the road department will be there to help in the interim.  Can the township break the contract with the Village 70/30. Mr. Murray said that contracts can be broken.  She commented on Rae Jean doing a good job.

 

Paul Goda, 431 W. Main Street, Spoke about October 1st meeting if we can change the visitor’s portion after reports?  Council would not be able to rebut if it was after their reports.

 

Larry Larson, 239 W. Main Street, Does the village have a policy for discipline for an employee.  Did you follow the policy for discipline for Rae Jean.  Mr. Murray said that they did.  Mr. Larson asked how the chief is doing?  We cannot comment on the chief’s sick leave.

Mr. Vest: Get out and vote tomorrow.

 

Mr. Bartlett: Mr. Bartlett needs to know about meeting on Friday since he will be out of town until Thurs. evening.  Commend the water department about the water main breaks this weekend. Thanks Cathy Katona for her efforts.  “Hats off to the village and all the workers.” Economic Development meeting November 13, 2007 @ 5:00 at Open Door Coffee House. Wish the candidates best of luck and please go out and vote.  Remember the veterans on Veterans Day.

 

Mr. Lee: Budget meeting next Monday, November 12, 2007 @ 4:30 p.m. He stated the rumors are going around and that we are not going to raise our water rates. 

 

Engineer’s Report

 

No report.

 

Fiscal Officer Report

 

I am from the township and I am up for re-election tomorrow although I have no opponent.  Looking into some new procedures to make things work more efficiently.

 

Administrator’s Report

 

Administrator Matt Zapp:  Mr. Zapp appreciates working with the current staff we have.  Help us with the snow due to our shortage of staff.  Leaf pickup will continue until the snow comes once snow switches over you will have to wait until springtime.  Madison Merchants meeting is on November 14, 2007 @ 8:00 a.m. at West Main Street Café.  Thanked Jeanne Scott at Jeannie’s Gift Baskets for her help in the merchant’s list.  Pertaining to the Water and Sewer Department we have asked Lake County Utilities to give us an extension and they are giving us until July 1 to decide what we are going to do and after July 1 we will be getting a increase and we will have to pass it on to our residents.

 

Mayor’s Report

 

The Mayor reported the Ordinance 49-2007 is a big step for our community; a big part due from our Economic Development Committee. The Madison Township voting precinct F has been moved to the Senior Center from Stratton Place.  Get out and vote the polls open at 6:30 a.m. till 7:30 p.m.

Motion by Mr. Vest, seconded by Mr. Britton to enter into Executive Session at 8:45 p.m., for matters of personnel and legal pertaining to safety and senior center.  No business upon return. Roll call for motion, 5 yeas.  Motion carried.

 

Council reconvened to Public Session at 10:12 p.m.
