VILLAGE OF MADISON

Regular Meeting

November 1, 2004

 

 

Record of Proceedings

 

Mayor Evangelista called the meeting to order at 7:03 p.m. and invited all in attendance to join in the Pledge of Allegiance to the American Flag.

 

Council members Mr. Britton, Mr. Buck, Mr. Burgard, Mr. Loparo and Mr. Vest were present. Also in attendance; Mayor Evangelista, Administrator Sample, Solicitor Murray, Fiscal Officer Pinkert and Engineer Foley.

 

Motion by Mr. Vest, seconded by Mr. Burgard, to approve the minutes of the regular meeting on October 18, 2004, as presented.  Roll call on the motion, 5 yeas.  Motion passed.

 

Fiscal  Officer Pinkert presented Pay Ordinance #2076 totaling $91,924.10 for current and upcoming expenses.  Motion by Mr. Burgard, seconded by Mr. Britton, to approve Pay Ordinance #2076.  Roll call on the motion, 5 yeas.  Motion passed.

 

 

VISITORS

 

Don Heywood, 36 Saxton Street, reported two possible safety issues and reviewed a plan for solving them that he submitted to Council (attached as part of these minutes).  Mayor Evangelista said that although the police department does issue a lot of citations regarding those issues, Acting Police Chief Forsythe will re-assess the situation. 

 

 

OLD BUSINESS

 

ORDINANCE NO. 63–2004 was read by Administrator Sample, second reading.  AN ORDINANCE AUTHORIZING AND DIRECTING THE VILLAGE ADMINISTRATOR AND FISCAL OFFICER TO ENTER INTO A CONTRACT WITH THE WESTFIELD COMPANIES THROUGH GEHRING'S AGENCY, INC. FOR GENERAL LIABILITY INSURANCE FOR MADISON VILLAGE, AND DECLARING AN EMERGENCY.

Motion by Mr. Loparo, seconded by Mr. Vest, to suspend the three reading rule for Ordinance No. 63-2004.  Roll call, 5 yeas.  Motion passed.  Motion by Mr. Loparo, seconded by Mr. Buck, to approve Ordinance No. 63-2004.  Roll call, 5 yeas.  Ordinance No. 63-2004 duly passed.

 

 

COUNCIL REPORTS

 

Motion by Mr. Britton, seconded by Mr. Loparo, to approve Old fashioned Days request for Christmas in the Park on December 4, 2005.  Roll call on the motion, 5 yeas.  Motion passed.

Mr. Britton reported that the Recreation District’s Halloween party at Stanton was a success and also encouraged everyone to vote on Tuesday. 

 

Mr. Vest complimented the Police Department on covering Halloween and also encouraged everyone to vote.

 

 

Mr. Loparo encouraged everyone to vote.

 

Mr. Buck informed everyone that there is Planning Commission meeting on November 8, 2004, at 7:00 pm and also encouraged everyone to vote.

 

Mr. Burgard reported that the Senior Citizen’s center addition is underway.

 

 

ENGINEER’S REPORT

 

Engineer Foley reported the following:

 

The work at Bear Path and Phase II at Huntington Woods is moving forward.

Mr. Britton asked if there will be a new curb at the YMCA after bear Path is opened.  Mayor Evangelista said that they would have to grade for it and Engineer Foley added that the front of the YMCA will be lawn. 

 

 

SAFETY DEPARTMENT REPORT

 

Acting Chief Forsythe reported the following:

 

No major incidents on Halloween.

Enforcement can be stepped up regarding Mr. Heywood’s concerns about safety.

The new cruiser is in and should be ready for service next week.

Officer Svagerko will be attending a Firearms Instructor Training Course.

The Police department will be qualifying on the M16 on Friday at 2:00 and invited Council to attend.

Jan Keiss received the “safe driver” award for October. 

 

 

ADMINISTRATOR’S REPORT

 

Administrator Sample, nothing to report.

 

 

Mr. Toward joined the meeting in progress and took his seat.

 

 

MAYOR’S REPORT

 

Mayor Evangelista reported the following:

 

Council will be holding another budget workshop in November and any questions should be directed to Administrator Sample or Fiscal Officer Pinkert.

The Village is part of the Multi-Jurisdictional Hazard Mitigation Plan developed by Lake County and submitted to the Federal Emergency Management Agency.

 

 

 

 

The design & Review Board approved its first application for a certificate of appropriateness.  Councilman Larry Buck submitted a plan to add a breezeway addition between his two buildings that was considered and approved.

 

A  resident of the Village feels his First Amendment rights have been violated through political sign restrictions and has brought a law suit against the Village.  Until the issued is settled, the Village will stop enforcing the political sign ordinance. 

The Recreation Board has requested Matt Zapp to be appointed to finish out the term left by Tom Bilek.  Motion by Mr. Britton, seconded by Mr. Buck, to appoint Matt Zapp to the Recreation Board for the balance of Tom Bilek’s term.  Roll call on the motion, 5 yeas and 1 abstain (Mr. Toward).  Motion passed.

Motion by Mr. Britton, seconded by Mr. Buck, to adjourn to executive session to discuss personnel issues.  Roll call on the motion, 6 yeas.  Motion passed.  Mayor Evangelista informed everyone that there would be no business after executive session.  Council adjourned to executive session at 7:40 pm.

 

Mayor Evangelista called the meeting to order at 8:00 pm.  Council members Mr. Britton, Mr. Buck, Mr. Burgard, Mr. Loparo, Mr. Toward and Mr. Vest were present.

 

Motion by Mr. Britton, seconded by Mr. Vest, to adjourn.  Roll call, 6 yeas.  Meeting Adjourned at 8:01 pm.
