Mayor Evangelista called the meeting to order at 7:00 pm and invited all in attendance to join in the Pledge of Allegiance.
Council Members Mr. Britton, Mr. Burgard, Mr. Buck, Mr. Loparo, Mr. Smith, and Mr. Toward were present. Also in attendance were Administrator Sample, Clerk-Treasurer Reed, Solicitor Murray, Chief Matty, and Engineer Foley.
Mr. Burgard motioned to approve the minutes of the October 21, 2002 meeting. Mr. Buck seconded. All present were in favor except Mr. Smith who abstained.
Clerk-Treasurer Reed presented Pay Order #2031 totaling $86,172.38. Mr. Buck motioned for approval. Mr. Smith seconded. All present were in favor.
Mr. Chuck Paine of J.C. Nifty Fifty Diner104 W. Main Street thanked Council for the donation of candy for Halloween. It was greatly appreciated.

ORDINANCE #40-2002 was read by Administrator Sample for the first time. AN ORDINANCE PROVIDING FOR ADDITIONAL APPROPRIATIONS AND ADJUSTMENTS TO VARIOUS LINE ITEMS TO CURRENT EXPENSES AND FOR OTHER EXPENDITURES OF THE VILLAGE OF MADISON, OHIO, FOR THE PERIOD BEGINNING JANUARY 1, 2002, TO AND INCLUDING DECEMBER 31, 2002, AND DECLARING AN EMERGENCY. Mr. Burgard motioned for suspension of the three reading rule. Mr. Smith seconded. All present were in favor. Administrator Sample offered a short explanation for Ordinance #40-2002. He explained that this is the time of year when the appropriated funds in the budget need to be adjusted. Some expenses may be somewhat less while others may be somewhat higher. For example, the sewer fund will not increase, but the insurance fund will decrease in the amount necessary to allow for pumps and supplies and additional utility costs. In the general fund an additional appropriation is being made for $20,000 for additional wages and additional Central Collection Agency fees. Administrator Sample noted that he doesn’t believe that the full amount will be needed, as ADP has paid funds from different funds, funds not planned on. He will go back and re-evaluate these funds. Mayor Evangelista noted one correction to be made in the “General Fund Additional Appropriations” should read $865,000. Mr. Smith motioned for passage of Ordinance # 40-2002. Mr. Buck seconded. All present were in favor.
Mr. Britton noted that Halloween went well, as he heard no complaints.
Mr. Smith reported that there is a Fire Board Workshop at Madison Village on Wednesday, November 6, 2002. He also reminded everyone to get out and vote.
Mr. Loparo hopes to see everyone at the polls.
Mr. Buck visited Mr. and Mrs. Sill the new owners of the Greenways Print Shop. They are looking for old pictures of the storefront.
Mr. Burgard also hopes to see everyone at the polls.
Engineer Foley reported they are still working with the developers of Village Glen to finalize Phase 1.
Chief Matty announced with regret that Officer Jason Clark has resigned as of November 15, 2002 to work with another agency. With regrets, Mr. Burgard motioned to accept Officer Clark’s resignation. Mr. Britton seconded. All present were in favor.
Chief Matty gave a quick re-cap of Halloween; it was a quiet night with 11 officers out in 8 units; 6 cruisers and 2 on bike patrol.
Commander Randy Skaggs of the Chardon Patrol Post contacted Chief Matty this week. He is conducting a DUI task force with target dates of November 13, 14, 15, and 16, 2002. This is a direct result of the last 2 fatalities on Route 20. They asked Madison Village to join with Madison Township, Geneva City, and Ashtabula Highway Patrol as well as Lake County, Chardon Post. Chief Matty is requesting help in funding from Council to cover the overlap shifts required for this task force. Mr. Toward motioned for approval. Mr. Burgard seconded. All present were in favor. Chief Matty stated that this would not involve time and ½ for anyone as he plans to use part time officers.
Chief Matty provided Council with a written update from the last radio meeting held. A 300-foot communication tower will be constructed behind the old safety center on Middle Ridge.
Administrator Sample stated that the leaf pick up is underway.
The recycling questionnaires went out to residents and continue to be returned. To date, 149 have said yes that they would be willing to pay for recycling, and 135 say no.
Mayor Evangelista reminded Council if they have any questions about Phase 2 of Huntington Woods, to contact Administrator Sample. A reminder also, that Kirk Bettley of Sweet Briar has a Public Hearing on December 2, 2002 at 6:30 pm, to change 9.87 acres from M-1 to R-3. On December 9, 2002 at 6:45 pm, C&G requested a Public Hearing to change 12.56 acres from R-2 to R-3.
Mayor Evangelista thanked Council for supporting the Joint Task Force on November 13,14,15, &16, 2002.
The auction that was discussed at an earlier meeting will wait until possibly March or April 2003.
Mayor Evangelista reminded Council of some upcoming dates; November 6, 2002 is a Storm Water Task Force Meeting at Mentor City Hall at 9:30 am, November 7, 2002 is Mayors Court, November 11 is Veterans Day and Planning Commission Meeting at 7:00 pm. November 18, 2002 is the next regular Council Meeting. Most importantly, tomorrow is Election Day, get out and vote.
Mr. Britton motioned to adjourn to executive session for the purpose of interviewing for the full time Police Department positions. Mr. Smith seconded. All present were in favor.
Upon returning from executive session and roll call taken with everyone present, Mr. Britton stated that Madison Village certainly has many qualified Officers. Ordinance #41-2002 is an Ordinance appointing James Middleton to a full time position effective immediately, provided he passes the Police and Fire physical. Mr. Britton motioned to suspend the three reading rule. Mr. Smith seconded. All present were in favor. Mr. Britton motioned for passage of Ordinance #41-2002. Mr. Smith seconded. Ordinance #42-2002 is an Ordinance appointing Kurt Svagerko to a full time position effective November 16, 2002, provided he passes the Police and Fire physical. Mr. Britton motioned to suspend the three reading rule. Mr. Toward seconded. All present were in favor. Mr. Britton motioned for passage of Ordinance #42-2002. Mr. Burgard seconded. All present were in favor.
Solicitor Murray proceeded with the swearing in of Officer James Middleton and Officer Kurt Svagerko. Congratulations to both Officer Middleton and Officer Svagerko.
