Minutes of Madison Village Meeting held October 21, 2002

 

 

PUBLIC HEARING             October 21, 2002

 

Mayor Evangelista called the Public Hearing to order at 6:45 pm.  Council members Mr. Britton, Mr. Burgard, Mr. Buck, Mr. Loparo, and Mr. Toward were present. Mr. Smith was absent.  Also in attendance were Administrator Sample, Clerk-Treasurer Reed, Solicitor Murray, Chief Matty and Engineer Foley.

 

The purpose of this Public Hearing, as explained by Mayor Evangelista is to take comments either for or against with regard to the zoning text change which would create a new definition for “Bed and Breakfast” in the B-1 district.  Administrator Sample also explained that the original definition for Bed and Breakfasts was limited to residential, single-family R-2 areas. The new definition will read as follows: A structure within which individual guest rooms are available for meals and lodging for compensation by prior arrangement, for not more than 14 guests and not longer than 72 consecutive hours.  Said use of sign shall be approved and authorized by the Planning Commission. 

 

With no questions or comments from the public, the Public Hearing was adjourned at 6:55 pm.

 

 

REGULAR MEETING            OCTOBER 21, 2002

 

Mayor Evangelista called the meeting to order at 7:00 pm and invited all in attendance to join in the Pledge of Allegiance. 

 

Council members Mr. Britton, Mr. Burgard, Mr. Buck, Mr. Loparo, and Mr. Toward were present.  Mr. Smith was absent.  Also in attendance were Administrator Sample, Clerk-Treasurer Reed, Solicitor Murray, Chief Matty and Engineer Foley. 

 

After the correction of the spelling of Reverend William Alvey’s name, Mr. Loparo motioned to approve the minutes of October 7, 2002.  Mr. Burgard seconded.  All present were in favor.

 

Clerk-Treasurer Reed presented Pay Order #2030 totaling $63,740.95.  Mr. Burgard motioned for approval.  Mr. Buck seconded.  All present were in favor.

NEW BUSINESS

 

ORDINANCE #38-2002 was read by Administrator Sample for the first time.  AN ORDINANCE AMENDING ORDINANCE NO. 33-1996, AS AMENDED, BY MODIFYING SECTION 2.1.12 BY CREATING SECTION 2.1.12 (a. AND SECTION 2.1.12 (b. ALL RELATED TO THE DEFINITION OF BED AND BREAKFAST.  Mr. Britton motioned to suspend the three reading rule.  Mr. Toward seconded.  All present were in favor.  Mr. Britton motioned for passage of Ordinance #38-2002.  Mr. Toward seconded.  All present were in favor.

 

ORDINANCE #39-2002 was read by Administrator Sample for the first time.  AN ORDINANCE AUTHORIZING AND DIRECTING THE VILLAGE ADMINISTRATOR AND CLERK-TREASURER TO ENTER INTO A CONTRACT WITH THE WESTFIELD COMPANIES THROUGH GEHRING’S AGENCY, INC. FOR GENERAL LIABILITY INSURANCE FOR MADISON VILLAGE, AND DECLARING AN EMERGENCY.  Mr. Buck motioned to suspend the three reading rule.  Mr. Burgard seconded.  All present were in favor.  Mr. Burgard motioned for passage of Ordinance #39-2002.  Mr. Buck seconded.  All present were in favor. 

 

 

COUNCIL REPORTS

 

Mr. Toward reported that he has been in contact with Nick’s Painting of Warren who might be interested in painting the water tower. 

 

Mr. Loparo informed Council that the Greenway’s building has indeed been sold to ReMax, a real estate company.  The printing business will be relocated to the basement with a rear entrance.  The front of the building will be refaced.  The owner of the side lot is interested in Council looking into the acquisition of the lot for public parking. 

 

Mr. Buck reported that he attended the Planning Commission Meeting on October 14, 2002.  There were 3 Public Hearings prior to the meeting.  The first Hearing was related to sales of specialty autos and mini storage facilities at 45 Edwards Street. The second one referred to Bed and Breakfast operations at 25 Park and 25 W. Main St.  The third Hearing was for rezoning of 9.87 acres off of Edwards Street for Bettley Builders from M-1 limited industry to R-3 multi-family. Mr. Buck and Mr. Vest of the Planning Commission are requesting Village Council to require Bettley Builders have a traffic study done at their expense before considering the request.  Planning Commission has set a Public Hearing for C&G Developers of Huntington Woods to rezone approximately 12 ½ acres near the Sidley Development to R-3 multi-family. That Public Hearing is set for December 9, 2002 at 6:45 pm. 

 

Mr. Burgard reported that he had the opportunity to visit the new restaurant in Madison, called Joey’s Place.  It was very nice. 

 

 

ENGINEER’S REPORT

 

None

 

 

ADMINISTRATOR’S REPORT

 

The leaf program is ongoing.  They will pick up leaves 3 days a week until approximately the first part of December. 

 

Administrator Sample informed Council that a Public Hearing must be set up for the rezoning of 9.87 acres of land.  This hearing could be set as soon as December 2, 2002 at 6:30pm.  Mr. Toward motioned to approve the Public Hearing date.  Mr. Burgard seconded.  All present were in favor.

 

 

MAYOR’S REPORT

 

On October 9, 2002, Chief Matty and Mayor Evangelista attended an award ceremony given by AAA.  Madison Village received several awards.  As a direct result of former Mayor David Reeds’ efforts in engineering the Safe Driver Award, Madison Village was a recipient of that prestigious award.   The second award received was for community recognition for providing documentation and community traffic safety leadership. Madison Village also received an award for its fatality free pedestrian safety record. 

 

Another award was received from the American Waterworks Association for excellence in management of employees in superior safety.

 

Mayor Evangelista asked Council to contact Administrator Sample with any questions regarding Phase 2 of Huntington Woods.  Also any questions concerning the Middle Ridge Community re-design should be directed to Administrator Sample.

 

Mayor Evangelista asked Council to consider the cost of the Route 2 study to be put in the budget for next year so the Village can participate in that study. 

 

Administrator Sample and Mayor Evangelista have been discussing and researching the possibility of a clock tower for the Village.  It can be customized with the corporation name and date on the face of the clock.  They will continue researching this for a price and location of the clock and get back to Council for their consideration.

 

Upcoming dates are as follows:  October 23, 2002 will be a Board of Zoning Appeals meeting with a Public Hearing before the meeting.  October 24, 2002 is Mayor’s Court, November 4, 2002 is the next Council Meeting at 7:00 pm, and November 11, 2002 is Veterans Day and also the next Planning Commission Meeting.

 

 

SAFETY DEPARTMENT REPORT

 

Chief Matty prepared an agenda for the Safety Committee.  He has a proposal for a new police badge with a 2003 Bicentennial logo on it.  It would be included in the 2003 budget. 

 

The next item on the agenda is a records management system update.  This would be a windows based system that would allow officers to access information from the field.  The cost of this would be approximately $25,000 and would include the program, training, and licensing.  

 

The deadline for the 2003-2004 patrol car will be next month sometime.  Chief Matty feels the Village will be better off going for outside bids. 

 

There is a program that came out several years ago called Quick Action Deployment.  Chief Matty and Officer Clark are trained instructors for this program.  It is not a rescue mission it is strictly a tactical plan to save lives.  One of the recommendations of this program is that some of the officers have rifles. At this time, the Village has no advanced weaponry.  Chief Matty has put in for approximately $1,200 for the purchase of AR 15 rifles.  This would allow the Village to purchase 2 weapons.

 

The remarking of the police cars is another subject for discussion.  Mayor Evangelista noted that he has spoken to John Soulsby of Madison about the design for the patrol cars. He can do any type of design and is interested in working with Council to come up with a specific design for Madison Village.  

 

An extended warranty is being offered for the 800-megahertz radios that were just purchased.  The existing warranty will expire in November of this year.  The cost of this extended warranty is just below the replacement cost of a new radio.  Chief Matty suggests the Village decline the extended warranty.  

 

Chief Matty would like to revisit the issue of a firing range.  Although there is a shortage of firing ranges, Madison Village is still fortunate enough to be able to use the Ashtabula Rod and Gun Club.  Chief Matty has checked with ODNR about the property along the Grand River and possibly using that area.   Administrator Sample is interested in finding an alternative, other than the scenic Grand River area.  He suggested finding a piece of property and joining with perhaps the Township, or Geneva or Perry.  Another thought he had is possibly the piece of property that the Fire District owns that is South of Route I-90 across from Route 307, even if it would be short term.

 

Chief Matty would like Council to consider the replacement of a full time officer.  They are still down one full time officer.  He asks that Council consider interviewing for this position by the end of the year so that that position is filled at the start of 2003.  This position is in the payroll budget for July to December of this year.  Chief Matty stated that some really well qualified officers are in part time positions right now.  A motion to interview the approximately 5 part time officers for the full time position after the November 4, 2002 Regular Council Meeting was made by Mr. Toward.   Mr. Burgard seconded.  All present were in favor. 

 

Chief Matty also has a request for several part time officers to be hired. 

 

Because of past experiences with certain bands that have played in the park, Chief Matty has some suggestions for guidelines for using the Village Park.  Not all Council Members were in agreement with all the guidelines. 

 

The Bike Patrol has been very widely accepted.  It was kicked off on Memorial Day and has made several arrests since.  Chief Matty plans to have a bike patrol out for Halloween.

 

Several Council Members commended the Police Department for doing their job.  They are proud of their community.

 

Mr. Loparo motioned for adjournment at 8:12 pm.  Mr. Britton seconded.  All present were in favor.
