Regular Meeting

September 4, 2007

 

 

Record of Proceedings

 

Mayor Evangelista called the meeting to order at 7:03 p.m. and invited all in attendance to join in the Pledge of Allegiance to the American Flag. Mayor Evangelista requested that everyone observe a moment of silence. Council Members Mr. Bartlett, Mr. Hamercheck, Mr. Lee, Mr. Loparo and Mr. Vest were in attendance.  Also in attendance Mayor Mike Evangelista, Solicitor Mike Murray, Administrator Matt Zapp, Fiscal Officer Brenda Brcak, Police Chief Mark Forsythe, and Engineer Eric Haibach.  Mr. Britton was absent.

 

Motion by Mr. Vest, seconded by Mr. Loparo that the Minutes from the Regular Meeting of Council dated August 20, 2007 be approved as amended.  Amendment made by Don Bartlett:  page 3, paragraph seven, second sentence – to read:  In reviewing the objective, bottom line evidence, the Chief’s social security number was inadvertently given out by the Village, and we have to assume responsibility for that.  The Chief had done nothing wrong, and was requesting protection for himself and his family.  Therefore, passing this Resolution is the right thing to do.

 

Fiscal Officer Brcak presented Pay Ordinance No. 2143 totaling $31,551.34 for payroll and $25,486.54 for current and upcoming expenses.  Motion by Mr. Bartlett, seconded by Mr. Vest, to approve Pay Ordinance No. 2143.  Roll call on the motion, 5 yeas.  Motion carried.

Old Business

 

ORDINANCE NO. 38-2007 was read by Solicitor Murray, second reading.  AN ORDINANCE AMENDING MADISON VILLAGE CODIFIED ZONING ORDINANCE NO. 33-1996 AND ALL AMENDMENTS THERETO TO AMEND SECTIONS 18.2, 18.3.1 REGARDING DISTRICT CHANGES AND THE FEE SCHEDULE.

 

New Business

 

RESOLUTION 22-2007 was read by Solicitor Murray.  A RESOLUTION IN HONOR AND RECOGNITION OF JOE ACCERA FOR HIS MANY YEARS OF DEDICATED SERVICE AND CONTINUED SUPPORT OF MUSIC IN OUR COMMUNITY.   Motion by Mr. Loparo, seconded by Mr. Lee to approve Resolution 22-2007.  Roll call on the motion, 5 yeas. Motion carried.

 

Council Hamercheck questioned the status of Ordinance 39-2007, which was included in the agenda packets, but not on the agenda.  Administrator Zapp advised to disregard.  This Ordinance was a repeat of one approved at our last Council Meeting.

 

 

Hearing of the Public

 

Larry Larson, 239 W. Main St.: Regarding his previous public record’s request.  To date he as received only copies of the requested performance evaluations.  When can he expect his request on what is considered a public record and what is not a public record per the Solicitor, e-mails of Council (if permitted) and a review of Chief Forsythe’s personnel file?  Solicitor Murray will follow through on areas of his request.  Fiscal Officer will advise Mr. Larson of an appropriate review time, following the approval of Solicitor Murray as to which documents can be released for public review.

 

JoAnn Dzopko, 1080 Edgewood (Township):  Addresses Council regarding activities of the Senior Center and Director Burguard.  She handed out a letter of concern to Council and the Mayor, outlining comments on program, expenses, and qualifications of the Director.  Questions were addressed to the Mayor as her supervisor as to time sheets, responsibilities, right to cash in unused vacation time, amount of time spent operating the Senior Center verses being in other places.  Requests for additional public records were made.

 

Mayor Evangelista updated that there will be a meeting of the Senior Center Council on September 5, 2007 to address concerns.  Director Burguard would not be in attendance.

 

Council Reports

 

Mr. Lee:  Questioned the Mayor on when an answer could be expected on a pending e-mail request, and what is the best e-mail address to use in sending requests to him: home, work or Village Hall.

 

·        Fire District Meeting – September 19, 2007.

 

Mr. Bartlett:  August had been a busy month with vacations and activities.  Now back and ready to move onto activities.

 

Mr. Bartlett updated that the Economic Development Committee had met on August 29, 2007.  They continue to move forward on CRA’s and economic development of the I-90 area. 

 

In other areas, the Ohio School Facilities Committee met on August 30, 2007.  Madison School District is moving forward with a $78 million bond issue on the November ballot.  The pending issued would be a 60% funded initiative by the State of Ohio and 40% funded by the residents of Madison Local Schools.  A Madison Community Profile is being put together at this time.  Once a levy is approved and construction completed, the properties of current school buildings can be sold.

 

·        The Madison Senior Center will  hold a Clambake fund-raiser on September 23, 2007.  Tickets can be obtained from any Council Member or by calling the Senior Center.

 

 

 

 

Mr. Loparo:  Upcoming Meetings –

 

·        Fire District – September 19, 2007

 

To address comments on the Senior Center –

·        The job description of the Senior Center Director is outlined in the bylaws of the Senior Center.  The bylaws is a document approved by both the Village and the Township.

·        A meeting will be held on September 5, 2007 for the Senior Council only.  This meeting will be held without the director and is not open to the public.

 

Resolution 22-2007 in honor of Joe Accera is a positive recognition of 30 years of community service.  The award ceremony was wonderful presentation and Mr. Fike did a wonderful job in putting this honor together.

 

 

Mr. Vest:  Upcoming Meetings –

                       

·        September 5, 2007 – The Lake County Comprehensive Plan will be presented at the County

 

Mr. Vest also reminded all that school is back in session.  We need to be cautious of young children walking to school, crossing the streets and catching buses.

 

Mr. Hamerchek:  The award presentation to Joe Accera was very well done.  A thank you to Mr. Fike for the wonderful job he did in getting this together.

 

Engineer’s Report

 

Engineer Eric Haibach reported that the paving project was completed at the Senior Center.  Seal coating of the drive is in the near future.  A water leak was found in the Village Glen project, and is being repaired.  The Hyder Road culvert plans are being completed and should be out for bid the second week of September.

 

Safety Report

 

Chief Forsythe reported that a 1995 Ford F150 is being taken to auction on September 7, 2007.  The truck was forfeited to the Madison Village Police Department through the Lake County Courts.  The month report is not yet completed.  The report will be completed tomorrow and made available to Council at that time.

 

Administrator’s Report

 

Administrator Matt Zapp updated that the Safford Street paving project is to start September 13, 2007.  This is being funded by FEMA.

 

Administrator Zapp thanked Council Hamercheck for updating the Village on the recent USDA and Grant Program presentation sponsored by Congressman LaTourette.  Fiscal Officer Brcak, Mr. Fike and himself attended.

 

A reminded to all, that mosquito spraying will be done in the Village on September 5, 2007.

 

Repairs to the Water Tower are now complete.  With the help of Ray Schultz from the Road Department, work could be done in half the anticipated time, saving the Village additional expenses in rental and welding service.

 

Fiscal Officer Report

 

Fiscal Officer Brenda Brcak, reported that the Lake County Budget Commission held the 2008 Tax Budget Hearing on August 15, 2007.  The Budget Commission has approved our 2008 Tax Budget as $102,908 to the General Fund, $22,246 to the General Obligation Debt Fund and $21,986 to the Police Pension Fund.  Total of 2 mills inside millage = increased revenue from our 2007 Tax Budget.

 

Meeting are being held with other Departments to get input on the departmental budgets for 2008.  As numbers are being shared, they are being updated to the master Budget document.

 

Mayor’s Report

 

The Mayor reported that the Design Review Board is looking at grant opportunities to support their projects.

 

In areas of economic development, Mentor RV is ready to break ground at their new location at Rt. 528 and I-90.

 

It was announced the Fiscal Officer Brenda Brcak has turned in her resignation and will be leaving the Village to return to the educational sector as a School Treasurer.  She will resume her new position October 8, 2007.

Motion by Mr. Bartlett, seconded by Mr. Hamercheck, to enter into Executive Session at 7:43 p.m., for legal matters and potential litigation, roll call 5 yeas.  Motion carried.

 

Council reconvened to Public Session at 8:25 p.m.

 

Motion by Mr. Lee seconded by Mr. Loparo that the meeting be adjourned at 8:25 p.m., roll call 5 yeas, Motion carried.  Meeting Adjourned.
